The subject of the contract is services in the field of forest management as defined in Article 6 (1) point 1 of the Act of 28 September 1991 on forests (text one: Journal of Laws of 2021 item 1275 as late as “Forests Act”) covering works in the field of forest breeding and protection, fire protection, harvesting and rips of timber for packages 3,4, and forestry services in the field of nursery management for package 14, to be carried out in the Kańczuga Forest District

The Contracting Authority provides for the possibility of awarding the contracts referred to in Article 214 (1) (7) of the PZP within 3 years from the date of the award of the basic contract.

The scope in kind of services which are the subject of contracts shall not exceed 50% of the value of the procution.The procedure shall be carried out in accordance with the rules laid down for the so-called 'reverse procedure' referred to in Article 139 (1), (3) to (4) of the PZP

In view of the provisions of Article 225 (1) of the PZP, if an offer has been made, the choice of which would lead to a tax obligation under the provisions of the Goods and Services Tax, the Contracting Authority shall, in order to assess such offer, include a tax on goods and services to the price presented therein, which would have an obligation to settle in accordance with those regulations.

16.3The Contractor's Offer, which will receive the highest number of points, will be considered the most advantageous offer in a given Package.

16.4.If the most favourable offer cannot be made due to the fact that tenders of the same price have been submitted, the Contracting Authority urges the Contractors who have submitted these tenders to submit additional offers containing the new price within the time limit specified by the Ordering Party.

9.2 For the purpose of meeting the conditions for participation in the proceedings referred to in paragraph 7.1. SWZ, the Contracting Authority, prior to the selection of the most favourable offer, shall call on the Contractor whose highest rated offer to submit within the prescribed time limit, not less than 10 days, current as of the date of submission of the following subject evidence measures:

(a) a list of services performed, and in the case of recurring or continuous benefits, also exercised, during the last 3 years (back from the date on which the deadline for submission of tenders), and if the operating period is shorter, including their gross value, object (type of service performed), dates of performance (dates of daily start and completion of services) and entities to whom services have been performed or are duly performed

If the Contractor relies on experience in the performance of services carried out jointly with other Contractors, the list referred to above concerns the services in which the Contractor directly participated and in the case of recurring or continuous benefits in which the performance of directly participated or participates.

(b) evidence determining whether the Contractor indicated in the list of services to confirm the fulfillment of the condition for participation in the procedure concerning technical or professional capacity in the field of experience have been performed or are performed duly,

The evidence referred to above is references or other documents drawn up by the entity to which the services were performed and in the case of recurring or continuous benefits, and if the Contractor for reasons independent of him is unable to obtain these documents — a declaration by the Contractor; in the case of recurring or continuous benefits, references or other documents proving their proper performance should be issued within the last 3 months (back from the date on which the deadline for submission of tenders expires).

(c) a list of persons addressed by the Contractor for the performance of the public contract, in particular responsible for the provision of services, including information on their professional qualifications, the rights (if required), necessary for the performance of the public contract, and the scope of their activities and information on the basis to dispose of those persons

(d) the list of technical equipment available to the Contractor for the purpose of performing a public contract together with information on the basis for disposal of these resources -

Notwithstanding the provisions of paragraph 21.7. above, in the event of a public procurement agreement, personal data will be processed until the expiry of the limitation period for claims arising from the public procurement agreement.

21.9.Personal data collected in connection with the conduct of this procurement procedure may be transferred to advisory services, including legal and consulting services,

21.10.Pursuant to Article 22 of the GDPR, decisions concerning personal data will not be taken in an automated manner.

21.11.The person to whom personal data obtained in connection with the conduct of this procedure shall have the right to:

1) access to your personal data — in accordance with Article 15 of the GDPR, where the performance of the obligations referred to in Article 15 (1) -3 GDPR would require an uncommensurable effort the Contracting Authority may request an indication of additional information aimed at clarifying the request, in Specifically specifying the name or date of the current or completed public procurement procedure;

2) to rectify your personal data — in accordance with Article 16 GDPR, whereby exercising the right to rectify or supplement personal data referred to in Article 16 of the GDPR may not result in a change in the outcome of the public procurement procedure, nor a change in the provisions of the contract in to the extent that is incompatible with the PZP and shall not compromise the integrity of the Protocol and its Annexes;

3) to request from the Contracting Authority — as controller, to limit the processing of personal data subject to the cases referred to in Article 18 (2) GDPR, whereby the right to restrict processing does not apply to storage, in order to ensure the use of legal protection measures or to protect the rights of another natural or legal person, or in view of important reasons of the public interest of the European Union or a Member State; this law does not limit the processing of personal data until the conclusion of the procurement procedure public;

4) lodge a complaint with the President of the Office for the Protection of Personal Data in the event that the processing of personal data violates the laws on the protection of personal data, including GDPR regulations.

21.12The obligation to provide personal data is a statutory requirement set out in the provisions of the PZP, related to participation in public procurement proceedings; the consequences of not providing specific data are determined by the PZP.

21.13.Person whose personal data has been obtained by the Contracting Authority in connection with the conduct of this procurement procedure is not entitled to:

1) the right to erase personal data, as exaggerated by Article 17 (3) (b, d or e GDPR),

2) the right to transfer personal data referred to in Article 20 of the GDPR referred to in Article 21 of the GDPR, the right to object to the processing of personal data, and this is due to the fact that the legal basis for the processing of personal data is Art. 6 para. 1 (c) GDPR.

21.14.Personal data may be transmitted to public authorities and government offices or other entities authorised under law or performing tasks carried out in the public interest or in the exercise of public authority, in particular to the leading entities control activity against the Contracting Party. Personal data shall be transferred to data processors on behalf of the personal data controller.
