The subject of these proceedings is the supply of electricity to facilities (energy consumption points, hereinafter also PPE) listed in Annex 1A, 1B, 1C to the SWZ – description of the subject of the contract, divided into parts of the contract: 1. Part I: supply of electricity for 2023, purchase according to TGE (variable price), in the amount of 8 155 514 kWh, to the PPE listed in Annex 1A to the SWZ, 2. Part II of the contract: supply of electricity for 2024 for street lighting, purchase at fixed prices, in the amount of 5 504 507 kWh, to the PPE given in Annex 1B to the SWZ, 3. III part of the contract: supply of electricity for 2024 for other facilities, purchase at constant prices, in the amount of 10 849 792 kWh, to the PPE given in Annex 1C to the SWZ.

electricity supply for 2023, purchase according to TGE

1. The subject of these proceedings is the supply of electricity to facilities (energy consumption points, hereinafter also PPE) listed in Annex 1A to the SWZ – description of the subject of the contract, divided into parts of the contract: Part I of the contract: supply of electricity for 2023, purchase according to TGE (variable price), in the amount of 8 155 514 kWh, to the PPE listed in Annex 1A to the SWZ, 2. The electricity demand referred to in paragraph 1 shall be a basic order. In the course of the contract, the ordering party reserves the right to reduce or increase the value of the order to the extent of +/- 15% in relation to the basic amount of electricity for the purchase of energy. The increase in the order quantity will take place on the basis of the right of option. Detailed information is included in the draft agreement (Annex 2A to the SWZ. 3. The detailed scope of the contract is specified in Annex 1 to the SWZ, in accordance with the provisions of the Energy Law Act of 10 April 1997. Other conditions regarding the execution of the contract are set out in the Draft provisions of the electricity sale agreement – Annex 2A to the SWZ. 4. Electricity will be supplied under the conditions specified in the provisions of the Energy Law Act of 10 April 1997 and in accordance with the implementing regulations issued to this Act, in particular with the customer service quality standards specified in the Regulation of the Minister of Energy of 29 November 2022 on the detailed rules for shaping and calculating tariffs and settlements in electricity trading. The quality parameters of electricity in the distribution part are regulated by the Regulation of the Minister of Economy of 4 May 2007 on the detailed conditions for the operation of the power system. 5. Distribution services will be provided on the basis of a separate agreement concluded by the contracting authority with the relevant Distribution System Operator (called DSO) – DSO data are included in Annex 1A to the DSO. The reserve seller is: Energa Obrót SA., Tauron Sprzedaż Sp. z o.o., PKP Energetyka S.A. 6. The requirements (obligations) for the contractor are described in the draft provisions of the sales contract constituting Annex 2A to the SWZ. Performing activities resulting from the power of attorney constituting Annex 2 to the Electricity Sales Agreement, hereinafter referred to as the Agreement. 7. Existing electricity sales agreements with existing electricity sellers for PPE included in Annex 1A SWZ are concluded for a definite and indefinite period, and the exact description for each of the PPE is provided in the column "R" of the above-mentioned Annex.
