The subject of the contract is the performance of repairs in the P4 maintenance level of 20 double-decker middle wagons type 416B and 2 double-decker control cars type 316B manufactured by Pojazdy Szynowe Pesa Bydgoszcz SA and repairs in the level of maintenance P5 of 26 double-decker middle cars of the Bpz series and 11 double-decker control cars of the ABpbdzf series manufactured by Bombardier Transportation GmbH.

2) information from the CRBR, referred to in paragraph 30 point 3 letter c) - submits information from the appropriate register containing information on its beneficial owners or, in the absence of such a register, another equivalent document issued by the competent judicial or administrative authority of the country in which the contractor has its registered office or place of residence, specifying its beneficial owners - issued no earlier than 3 months before their submission.

The subject of the contract in the scope of task No. 1 is - the performance of repairs in the maintenance level P4 of 20 double-decker middle wagons type 416B and 2 double-decker control cars type 316B along with additional works and delivery, replacement of brake discs and monoblock wheels.

The Ordering Party requires the execution of repairs in the P4 maintenance level of each double-decker wagon together with additional works and delivery, replacement of brake discs and monoblock wheels, within no more than 40 calendar days, counting from the date of handing over the double-decker wagon for repair, within the scope of task No. 1.

1. In all the records of the SWZ and its annexes where the Contracting Authority refers to standards, technical assessments, technical specifications and technical reference systems, in accordance with Article 101 (4) of the Pzp Act, the application of equivalent solutions, standards, technical assessments, technical specifications and technical reference systems as indicated in the SWZ and the annexes. Where equivalent solutions are used, the Contractor shall be obliged to demonstrate in writing the equivalence of the technical parameters offered in respect of the subject of the contract.

2.The detailed manner of performing the contract is specified in the Draft Provisions of the Agreement, constituting Annex No. 8 and 8.1 to the SWZ (respectively for a given task) and in the annexes to the Draft Provisions of the Agreement.

3. The Ordering Party requires that the Contractor and the subcontractor (in the case of entrusting part of the contract to a subcontractor by the Contractor) perform the order with employees employed under an employment contract in the scope of activities indicated in § 4 of the Proposed provisions of the contract constituting Annexes 8 and 8.1 to the SWZ.

The method of documenting the employment of employees, the Ordering Party's rights to control the Contractor's compliance with the requirements and sanctions for failure to meet specific requirements are included in the Draft provisions of the contract constituting Annexes 8 and 8.1 to the SWZ.

4.The Contracting Authority requires that the subject of the contract be provided by the Contractor, which has implemented a quality management system based on the IRIS standard (ISO/TS 22163) for the maintenance of railway vehicles. The subject of the contract should be carried out in compliance with the requirements in terms of quality, reliability and technical safety, in accordance with such a standard.

5. In the event of the need to perform welding works, the Ordering Party requires that before performing them, the Contractor presents a certificate and a list of qualified personnel enabling welding in accordance with the PN-EN 15085: 2 standard.

6.The Ordering Party requires a quality guarantee for a period of at least 18 months, counting from the date of signing the commission acceptance protocol of a given double-decker wagon, for works performed under the subject of the contract or for the entire wagon after repair, depending on the Contractor's choice.

3) the certificate referred to in paragraph 30 point 3 letter d), the certificate. or other document confirming that the Contractor is not in arrears with the payment of social or health insurance contributions referred to in paragraph 30 point 3 letter e, or a copy or information from the National Court Register or from the CEiDG, referred to in paragraph 30 point 3 letter f) – submits a document or documents issued in the country where the Contractor has its registered office or place of residence, confirming, as appropriate, that:

a) has not violated the obligations regarding the payment of taxes, fees or social security or health insurance contributions – issued not earlier than 3 months before their submission,

(b) its liquidation has not been opened, its bankruptcy has not been declared, its assets are not managed by a liquidator or court, it has not entered into an arrangement with creditors, its business activity is not suspended or it is not in any other such situation resulting from a similar procedure provided for in the provisions of the place where the procedure is opened – issued no earlier than 3 months before their submission.

The subject of the contract within the scope of task No. 2 is the performance of repairs in the P5 maintenance level of 26 double-decker middle wagons of the Bpz series and 11 double-decker control cars of the ABpbdzf series along with additional works, delivery of monoblock wheels and their replacement.

The Ordering Party requires repair in the P5 maintenance level of each double-decker wagon together with additional works, delivery of monoblock wheels and their replacement, within no more than 50 calendar days, counting from the date of handing over the double-decker wagon for repair, within the scope of task No. 2.
