The subject of this contract is the supply of electricity to the facilities listed in Annex 1 to the SWZ – Material and financial form. The demand for electricity in the period from 01.01.2024 to 30.06.2025 is: 2 035 400 kWh (planned order).

After selecting the most advantageous tender, the Municipality of Rokietnica and the above-mentioned organisational units will award the public contract in their own name and on their own behalf, concluding separate public procurement contracts for this purpose. The subject of the contract is the supply of electricity with established quality standards. The price does not affect the quality of the service provided, i.e. the supply of electricity. Electricity cannot be adapted to the specific requirements of the Ordering Party – it is standardized and offered in generally accepted standards. The rules for the operation of the power system are set out in the Regulation of the Minister of Economy of 4 May 2007 on the detailed conditions for the operation of the power system (Journal of Laws of 2007 No. 93, item 623, as amended) amended by the Regulation of the Minister of Climate and Environment of 27 September 2022 amending the Regulation on the detailed conditions for the operation of the power system (Journal of Laws of 2022, item 2007). The rules for shaping and calculating tariffs and settlements in electricity trading are specified in the Regulation of the Minister of Climate and Environment of 29 November 2022 (Journal of Laws of 2022, item 2505, as amended). 4. The contracting authority shall not divide the contract into lots. Conducting joint proceedings for the purchase of energy is to obtain favorable prices due to the increased volume. The inclusion of several collection points in the subject of the contract increases the chance of receiving offers, and also allows "small" customers to obtain more favorable prices. Aggregate the order (one procedure) gives a chance to obtain a more advantageous offer than in the case of division into parts. Dispersion of the contract by dividing the contract into lots could result in the non-receipt of a tender for low-consumption facilities that are not attractive to economic operators. 4.5. The contracting authority does not provide for requirements for the employment of persons referred to in Article 96(2)(2) of the PPL. 4.6. The contracting authority reserves the right to use Article 139(1) of the PPL, i.e. the possibility of first examining and evaluating bids, and then subjective qualification of the contractor whose bid was rated the highest, in terms of the lack of grounds for exclusion and meeting the conditions for participation in the procedure. 4.7. Distribution agreements are provided on the basis of separate agreements concluded between the ordering party and the Distribution System operator. (called OSD0). Distribution services are provided by ENEA Operator Sp. z o.o. Strzeszyńska 58, 60-479 Poznań. 4.8. The seller of electricity is Enea S.A. Pastelowa 8, 60 -198 Poznań. 4.9. The Contractor will be obliged to perform activities resulting from the power of attorney, sale of electricity, hereinafter referred to as the Agreement. The Contracting Authority shall grant the contractor selected in the proceedings a power of attorney to: 4.9.1. Notification of the relevant Distribution System Operator (DSO) on the conclusion of the Electricity Sale Agreement and on the planned date of commencement of electricity sales, 4.9.2. Representing the ordering party in contacts with the current Electricity Seller or Distribution System Operator in matters related to the process of changing the Seller applies to the collection points listed in Appendix 1 to the Agreement. 4.9.3. Representing the Ordering Party in contacts with the Distribution System Operator in matters related to the process of submitting the Seller to new electricity consumption points for which the Ordering Party received from the DSO the contract number for the provision of electricity distribution services.
