The subject of the order are successive deliveries of unleaded Pb-98 gasoline, unleaded Pb-95 gasoline and diesel fuel (summer, intermediate and winter) in the period from 01/10/2019 to 30/09/2022, on the terms specified in the draft contract.

1. The subject of the order are successive deliveries of unleaded Pb-98 gasoline, unleaded Pb-95 gasoline and diesel oil (summer, intermediate and winter) in the period from 01/10/2019 to 30/09/2022, on the terms specified in the draft contract.

2. The estimated amount of demand during the contract period is:

1) - unleaded petrol Pb-98 - 90 m 3

2) - Pb-95 unleaded petrol - 750 m 3

3) - diesel fuel: - 1 680 m 3

3. The Purchaser reserves the right to resign from this part of the delivery which he will not use during the term of the contract - however, not more than 30% of the quantities indicated in paragraph 2. The Contractor shall not make any claims for damages in this respect.

4. The abovementioned fuels must meet the quality requirements set out in

1) Act on the fuel quality monitoring and control system of 25.8.2006 (Journal of Laws of 2018, item 427, as amended);

2) Regulation of the Minister of Economy on quality requirements for liquid fuels of October 9, 2015 (Journal of Laws of 2015, item 1680);

3) Quality standards: PN-EN 228 + A1: 2017-6 (for unleaded petrol) and PN-EN 590 + A1: 2017-06 (for diesel) or equivalent.

6. The Contractor shall supply fuel to the Customer's Fuel Station, located in Sanok at Jana Pawła II 59 street by his own efforts and at his own expense.

7. The ordered fuels will be used by the Employer both for own needs and for resale. The Employer holds a License for trading in liquid fuels issued by the President of the Energy Regulatory Office in force until 31.12.2030.

8. Delivery details:

1) the fuel supply being the subject of the contract will be carried out in parts corresponding to the current needs of the Employer;

2) the contractor will be required to deliver fuels on the next day compared to the day the order was placed, in quantities and assortment strictly corresponding to the order placed by the Employer;

3) The Contractor is obliged to attach to each delivery a confirmed copy of the current quality attestation of the fuel supplied and a fuel release document from the fuel terminal;

4) The Ordering Party requires that fuel deliveries be carried out using road tankers equipped with a trigger with a fuel meter and a printing device containing at least information on the quantity of fuel released and its temperature;

5) fuel acceptances will take place on business days from Monday to Friday between 6:00 and 19:00.

9. The Purchaser reserves the right to take samples of the supplied fuel at each delivery and to submit it for examination in an independent laboratory in the manner and on the terms set out in the Regulation of the Minister of Economy of 1.9.2009 on the method of sampling liquid fuels and liquid biofuels ( Journal of Laws of 2014, No. 147, item 1035).

10. The settlement of the amount of supplied fuels will take place in accordance with the PN-ISO 91-1: 1999 standard, i.e. at a reference temperature of +15 about C using a legalized tank counter.

11. The Contractor is obliged to obtain an entry in the list referred to in Art. No later than 30.9.2019. 105c of the Act on tax on goods and services (Journal of Laws 2018 item 2174 as amended - hereinafter referred to as the Act) kept by the minister competent for public finance and the amount of the guarantee deposit paid by the Contractor, referred to in Art. 105b corresponds to at least one-fifth of the amount of tax due on the value of sales of goods referred to in item 10 of Annex 13 to the Act expected in a given month, however, not less than PLN 1,000,000. The Contractor is obliged to ensure that the Contractor is listed in the list referred to in Art. 105c paragraph 1 of the Act.
