The subject of the contract is the design and construction of a maintenance and repair base for railway vehicles in Radom.
1. The subject of the contract is the design and construction of a maintenance and repair base for railway vehicles in Radom.
2. The order includes the design and construction of a maintenance and repair base for railway vehicles in Radom (railway vehicle maintenance point), i.e. a maintenance and repair hall with workshops, a battery room and a warehouse and a garage, a social and office building, a compressor room, a central heating boiler room, a hazardous materials warehouse, a room for industrial waste, a rolling stock wash, necessary infrastructure and land development on plots no. 3/144, 3/64, 3/67, 3/151, 3/145, 3/37, 3/41 – precinct 0091 in Radom and delivery of equipment in accordance with the provisions of the SWZ.
3. A detailed description, scope and manner of implementation of the subject of the contract is specified in the SWZ together with attachments, including the Draft provisions of the contract constituting Annex 13 to the SWZ and the Functional and Utility Program - abbreviated version constituting Annex 12 to the SWZ.
4. In all provisions of the SWZ and its annexes, in which the Contracting Authority refers to standards, technical assessments, technical specifications and technical reference systems, in accordance with Article 101(4) of the PPL, the Contracting Authority shall allow the use of solutions equivalent to solutions described in standards, technical assessments, technical specifications and technical reference systems indicated in the SWZ and annexes, if they allow to obtain features or parameters not worse than those referred to in SWZ and annexes. If equivalent solutions are applied, the Contractor shall prove in the tender, in particular by means of the evidence referred to in Articles 104-107 of the PPL, that the proposed solutions meet the requirements set out in the description of the subject of the contract to an equivalent degree.
5. If the Contractor fails to submit the evidence in question or the evidence submitted is incomplete, the Contracting Authority shall call for their submission or supplementation within the prescribed period – legal basis of Article 107(2) of the PPL.
The above does not apply if, despite the submission of the evidence in question, the offer is subject to rejection or there are grounds for invalidating the proceedings – legal basis of Article 107(3) of the PPL.
6. The Contracting Authority requires that the Contractor, subcontractor or further subcontractor perform the contract with employees employed under an employment contract (in particular construction workers performing demolition, masonry, carpentry, earth, assembly, installation, finishing etc. works during the performance of the contract) – if the performance of these activities consists in performing work in the manner specified in Article 22 § 1 of the Labour Code, with the exception of persons performing independent functions in construction, including supervision and performing design work. Detailed information in this respect is set out in the Chapter. III section 8 SWZ and Draft provisions of the agreement constituting Annex 13 to the SWZ.
7. Before proceeding with the preparation of the offer, the Contractor will be obliged to make a local inspection of the place of performance of the subject of the contract and its surroundings, in order to assess the documents and information provided as part of the procedure, in particular to compare the description of the subject of the contract prepared by the Contracting Authority in proceedings with the conditions existing at the place of performance of the subject of the contract. The contracting authority will organize local inspections on plots no. 3/144, 3/64, 3/67, 3/151, 3/145, 3/37, 3/41 – precinct 0091 in Radom (T. Mazowieckiego Street in Radom). The dates of the vision were indicated in the SWZ. It is the Contractor's responsibility to participate in at least one date of the vision
8. The Contracting Authority requires the Contractor to provide at least a 5-year quality guarantee for the built maintenance and repair base for railway vehicles in Radom together with the railway infrastructure and a 3-year quality guarantee for the delivered equipment, machines, vehicles, counting from the date of signing the Final Acceptance Protocol by both Parties
