1. The subject of the contract is the constant and comprehensive service of the employees of the Ordering Party or persons who are not employees of the Ordering Party indicated by the Contracting Authority, in connection with foreign travel, in the scope of:

1.1. booking and redemption of airline tickets on foreign routes and related services;

1.2. booking and purchase of accommodation abroad together with the conduct of all related formalities.

2. Description of the item of the order is Annex 7 to the SWZ.

3. The specific scope of the Contractor's duties is set out in the documentation of the procedure in particular in Annex No 8 to the SWZ “Designed Contract Provisions”.

1. The subject of the contract is the constant and comprehensive service of the employees of the Ordering Party or persons who are not employees of the Ordering Party indicated by the Contracting Authority, in connection with foreign travel, in the scope of:

1.1. booking and redemption of airline tickets on foreign routes and related services;

1.2. booking and purchase of accommodation abroad together with the conduct of all related formalities.

2. The estimated demand of the Ordering Party is specified in the description of the subject of the contract (Annex 7 to the SWZ) and relates to the entire duration of the contract. However, the contract will be exercised in accordance with the actual needs of the Ordering Party. The Contracting Authority reserves the possibility of increasing or decreasing the scope of the contract subject in relation to the estimated quantities, i.e. the services procured during the course of the contract may differ quantitatively from the estimated quantities (both may be greater or less), however the total value of partial contracts shall not exceed the total value of the funds indicated in the contract.

3. The Contracting Authority shall use a minimum of 30% of the value of the order subject to paragraph 5.2 of SWZ. The remaining 70% of the value the Contracting Authority will use if such a need arises. The Contractors shall not have compensation claims against the Contracting Authority for the failure to use the Contracting Authority in the full amount of the value of the contract, in particular with respect to remuneration. The reduction in the quantity and/or value of the funds allocated by the Contracting Authority to carry out the subject of the contract may not be the basis for redress by the Contractor.

4. The contract will be executed successively from the date of conclusion of the contract until 31 December 2021 or until the amount specified in the contract is exhausted, whichever occurs first, subject to paragraph 5.2 of SWZ, except that the termination of the contract does not relieve the Contractor from the conduct of matters related to the implementation of travel for which were purchased by the Ordering Party airline tickets and accommodation reservations.

5. The Contracting Authority informs that in the event of failure to use min. 30% of the amount equivalent to gross remuneration indicated in § 5 of the Agreement, during the period from the date of conclusion of the contract to 31 December 2021, there will be an automatic extension of the term of the contract until the date of conclusion of the contract until 31 December 2021. fulfillment of this condition, however, no longer than 31.12.2022, subject to § 2 (3) to 5 of Annex 8 to SWZ (Designed Contract Provisions).

6. The Contracting Authority requires employment by the Contractor or subcontractor on the basis of the employment relationship, within the meaning of Article 22 (1) of the Act of 26 June 1974. The Labor Code (i.e. 2020, item 1320 as amended), persons performing the following activities in the field of execution of the contract: and the sale of airline tickets on foreign routes and related services and booking sales of accommodation abroad together with the conduct of all related formalities — details in the SWZ.

7. The Contractor shall be obliged to hold for the duration of the contract, including in the course of the performance of the services, valid insurance protection arising from the contract of insurance against the Contractor's liability in respect of its activities related to the subject of the contract. The scope of insurance resulting from the foregoing insurance contract should cover at least the possible payment of compensation by the Contractor to the Contracting Authority for failure or improper performance of the contract. The sum of insurance resulting from the above insurance contract should be at least PLN 300 000,00 for one and any insurance events. The Contractor shall, within 3 days from the date of signing the contract, submit to the Contracting Authority a certificate or copy of the insurance policy confirming the conclusion and validity of the insurance contract meeting the requirements set out above — details of the SWZ.
