Description:
Wałecka Grupa Zakupowa. Supply of electricity in the period from 01.01.2024r. to 31.12.2024r.

1. The subject of the contract is the supply of electricity in the period from 01.01.2024. to 31.12.2024r. up to 2,169 consumption points with a total estimated volume - basic order – 23,061.26 MWh, including:

1) For premises and facilities - other tariff groups (Part 1 of the order) - 12 050.61 MWh - the PPE list is attached as Annex 1a to the SWZ

2) For premises and facilities - tariff group B (Part 2 of the order) - 5 979.95 MWh - the PPE list is Annex 1b to the SWZ

3) For the needs of road lighting (Part 3 of the contract) – 5 030.70 MWh – the PPE list is attached as Annex 1c to the SWZ

2. The condition for starting electricity deliveries within the indicated time limit (for individual consumption points) is a positive completion of the procedure of changing the supplier.

3. The contracting authority Gmina Czarnków provides for the right of option - Part 1 of the contract.

4. The Contracting Authority reserves the right to use Article 139(1) of the PPL.

SUPPLY OF ELECTRICITY TO PREMISES AND FACILITIES – other tariff groups

1. Number of metering systems accounting for consumed electricity 1 283 pcs.

2. A detailed description of the pre-emptive points (PPE) of the Contracting Party included in Annex No 1a to the SWZ.

3. Estimated electricity consumption during the term of the contract – basic order –

12 050,61 MWh. Consumption figures are indicative.

4. Deliveries will take place from 01.01.2024. until 31.12.2024, subject to different deadlines for individual PPEs - details of delivery dates for individual consumption points are described in Annex 1a to the SWZ column "Delivery period".

5. The Contracting Authority Gmina Lubasz has the status of a Producer for PPE No. 590310600001372962, detailed data on the capacity of the installation and the planned amount of energy produced can be found in Annex 1a to the SWZ. The contracting authority agrees to conclude a contract for the resale of energy on the model used by the contractor.

6.The Ordering Party, the Academy of Applied Sciences in Wałcz, has the status of a Manufacturer for PPE No. 590310600000507891. The contracting authority will agree to conclude contracts for the resale of energy on the model used by the contractor. Details on the capacity of the installation, the amount of energy to be resold are included in Annex 1a to the SWZ.

7. The current electricity supply contracts will expire or terminate with effect on the day prior to the scheduled start date (“Supply Period” column). The obligation to terminate contracts is on the side of the contracting (recipients).

8. The contracting authority Gmina Czarnków reserves the right to extend the period of electricity supply for 1 PPE under the option. The right of option will cover the supply of electricity from 01.04.2024. However, no longer than until 31.12.2024.

9. Quality standards

1) The subject of the order is the supply of electricity with certain quality standards in accordance with applicable regulations.

2) Electricity quality standards are described in the EP Act and in the Regulation of the Minister of Climate and Environment of 22 March 2023 on the detailed conditions for the operation of the power system (Journal of Laws of 2023, item 819). The rules for shaping and calculating tariffs and settlements in electricity trading are specified in the Regulation of the Minister of Climate and Environment of 29 November 2022 (Journal of Laws of 2022, item 2505 with późń.zm.).

10. CPV code under which the subject of the contract is classified: 09300000-2 - Electricity, heat, solar and nuclear, 09310000-5 - Electricity.

11. The Contractor, based on the Power of Attorney granted, will be obliged to submit the contract on its own behalf and the contracting authority to the relevant DSO in accordance with applicable regulations and to represent it before the DSO in the process of changing the seller.

12. The contracting authority reserves the right to use Article 139(1) of the PPL, i.e. the possibility of first examining and evaluating bids, and then selecting the contractor whose bid was rated the highest in terms of the lack of grounds for exclusion and meeting the conditions for participation in the procedure.

13. As a result of the settlement of the proceedings - part 1, 23 contracts will be concluded.

14. The Ordering Party demands a bid bond - part 1 of the contract: PLN 140,000.00.

15. The contracting authority requires the provision of a performance bond, the contractor shall provide 23 performance bonds separately for each contract concluded.

SUPPLY OF ELECTRICITY TO PREMISES AND FACILITIES – tariff group B

1. Number of measuring systems accounting for consumed electricity 12 pcs.

2. A detailed description of the pre-emptive points (PPE) of the Contracting Party included in Annex No 1b to the SWZ.

3. Estimated electricity consumption during the term of the contract – 5 979.95 MWh. Consumption data are indicative.

4. Deliveries will take place from 01.01.2024. until 31.12.2024, subject to different deadlines for individual PPE - details of delivery dates for individual consumption points are described in Annex 1b to the SWZ column "Delivery period".

5. The Ordering Party Miejska Kanalizacja i Wodociągi Sp. z o.o. in Czarnków has the status of a Producer for PPE with numbers: 590310600000620255, 590310600000635129, detailed data on the capacity of the installation and the planned amount of energy produced can be found in Annex 1b to the SWZ. The contracting authority will agree to conclude contracts for the resale of energy on the model used by the contractor.

6. The Ordering Party Przedsiębiorstwo Wodociągów i Kanalizacji w Wyrzysku Sp. z o.o. has the status of a Producer for PPE with numbers: 590310600002313155, 590310600018582897, detailed data on the capacity of the installation and the planned amount of energy produced can be found in Annex 1b to the SWZ. The contracting authority will agree to conclude contracts for the resale of energy on the model used by the contractor.

7. The measuring systems shall be adapted to the procedure of changing the seller.

8. The electricity supply contracts currently in force will expire on the day preceding the planned start date of supply (column 'Delivery period').

9. For all PPEs, the change of seller will take place once again.

12. The Contractor, based on the Power of Attorney granted, will be obliged to submit the contract on its own behalf and the contracting authority to the relevant DSO in accordance with applicable regulations and to represent it before the DSO in the process of changing the seller.

13. The contracting authority reserves the right to use Article 139(1) of the PPL, i.e. the possibility of first examining and evaluating bids, and then selecting the contractor whose bid was rated the highest in terms of the lack of grounds for exclusion and meeting the conditions for participation in the procedure.

14. As a result of the settlement of the proceedings - part 2, 6 contracts will be concluded.

15. The Ordering Party demands a bid bond - part 2 of the contract: PLN 65,000.00.

16. The contracting authority requires the provision of a performance bond, the contractor shall provide 6 performance securities separately for each contract concluded.

Supply of electricity for the needs of road lighting

1. Number of metering systems accounting for consumed electricity 874 pcs.

2. A detailed description of the pre-emptive points (PPE) of the Contracting Party is included in Annex No 1c to the SWZ.

3. Estimated electricity consumption during the term of the contract – 5 030.70 MWh. Consumption data are indicative.

4. Deliveries will take place from 01.01.2024. until 31.12.2024, with the reservation that details of delivery dates (start and finish) in relation to individual collection points are described in Annex 1c to the SWZ column "Delivery period".

5. Current electricity supply contracts will expire or terminate with effect from the day preceding the planned delivery start date (column 'Delivery period'). The obligation to terminate the contracts lies with the contracting authorities (recipients).

10. As a result of the settlement of the proceedings - part 3, 13 agreements will be concluded.

11. The Ordering Party requests a bid bond - part 3 of the contract: PLN 55,000.00.

12. The contracting authority requires the lodging of a performance bond, the contractor shall provide 13 securities of proper performance of the contract separately for each contract concluded.
