The subject of the contract is the collection and management of waste from the area of the Tuchów Commune and the creation and operation of the Selective Rainfall Collection Point divided into 3 parts:

Part 1 – Collection and management of municipal waste from residential properties in the Tuchów Commune and from PSZOK in the period from January 1, 2024 to December 31, 2024

Part 2 – Collection and management of municipal waste from uninhabited buildings owned by the Municipality of Tuchów and from public utility areas of the City and Commune of Tuchów in the period from 1 January 2024 to 31 December 2024 together with additional options: handling illegal landfills and cleaning the world organized in the Municipality of Tuchów.

Part 3 – Establishment and operation of the Selective Municipal Waste Collection Point (PSZOK) in the Tuchów Commune in the period from 1 January 2024 to 31 December 2025

The subject of the contract is the collection and management of municipal waste from real estate residing in the municipality of Tuchów and from the Selective Municipal Waste Collection Point (PSZOK) located in the Municipality of Tuchów and transferring them to the appropriate waste treatment installation or replacement installation.

The deadline for performance of the contract shall be set for the period from the date of conclusion of the contract, but not earlier than from 1 January 2024 to 31 December 2024.

6. The scope of the subject of the contract includes:

1) collection of municipal waste generated in the Municipality of Tuchów – coming from real estate where residents live – from containers or bags for municipal waste, on the principles set out in the resolutions referred to in paragraph 4;

2) ongoing equipment of property owners with bags for collecting municipal waste;

3) development, printing and distribution of municipal waste collection schedules among the owners of real estate covered by the municipal waste management system in the Tuchów Municipality;

4) transfer of municipal waste collected from real estate from the municipality of Tuchów and from PSZOK to an appropriate waste treatment installation or a replacement installation for their management.

The detailed scope of the contract is indicated in the description of the subject of the contract - Annex No. 1.1 to the SWZ.

1. The subject of the contract is the collection and management of municipal waste from uninhabited buildings owned by the Municipality of Tuchów and from public utility areas of the City and Commune of Tuchów in the period from the date of conclusion of the contract, but not earlier than from 1 January 2024 to 31 December 2024, together with additional optional benefits, i.e.:

• Liquidation of Illegal landfills – by which the Ordering Party means the collection by the Contractor into bags of waste dispersed in areas owned by the Municipality of Tuchów indicated by the Ordering Party, loading of waste, their transport and management in accordance with the other conditions resulting from the public procurement agreement

• Handling cleaning operations in the Municipality of Tuchów – by which the Ordering Party means the collection by the contractor of waste packed in bags, their transport and management in accordance with the other conditions resulting from the public procurement contract

2. The Contractor is obliged to perform the subject of the contract in accordance with applicable regulations, in particular: the Act of 27 April 2001 - Environmental Protection Law (i.e. Journal of Laws of 2022, item 2556, as amended), the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (i.e. Journal of Laws of 2022, item 2519, as amended), the Act of 14 December 2012 on waste (i.e. Journal of Laws of 2022, item 699, as amended) and applicable acts of local law (Regulations for maintaining cleanliness and order in the Municipality of Tuchów and resolution on the detailed manner and scope of providing services in the field of collecting municipal waste from uninhabited properties and managing this waste in exchange for a fee for municipal waste management paid by the Municipality of Tuchów), together with implementing acts.

3. The deadline for performance of the contract shall be set for the period from the date of conclusion of the contract, but not earlier than 1 January 2024, until 31 December 2024.

4. The scope of the contract includes:

1) collecting municipal waste generated in the Tuchów Commune – coming from uninhabited real estate, public utility places, markets, street baskets and the parish cemetery – from containers or bags for municipal waste, on the terms set out in the resolutions referred to in paragraph 4;

2) current equipment of uninhabited real estate, public places, markets, street baskets and the parish cemetery with bags for collecting municipal waste in the amount corresponding to the bags with waste taken;

3) waste collection should take place according to the schedule attached to the contract.

The detailed scope of the contract is indicated in the description of the subject of the contract - Annex No. 1.2 to the SWZ.

The subject of the contract is the establishment and operation of the Selective Municipal Waste Collection Point (PSZOK) in the Municipality of Tuchów, accepting to PSZOK selectively collected municipal waste from residential properties located in the Municipality of Tuchów, covered by the fee for municipal waste management and transferring them to the entity authorized to manage them.

The Contractor is obliged to perform the subject of the contract, in accordance with applicable regulations, in particular: the Act of 27 April 2001 - Environmental Protection Law (i.e. Journal of Laws of 2022, item 2556, as amended), the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (i.e. Journal of Laws of 2022, item 2519, as amended), the Act of 14 December 2012 on waste (i.e. Journal of Laws of 2022, item 699, as amended), the Act of 3 October 2008 on providing information on the environment and its protection, public participation in environmental protection and on environmental impact assessments (i.e. Journal of Laws of 2023, item 1094, as amended), the Act of 11 September 2015 on waste electrical and electronic equipment (i.e. Journal of Laws of 2022, item 1622, as amended), Act of 24 April 2009 on batteries and accumulators (i.e. Journal of Laws of 202, item 1113, as amended), Regulation of the Council of Ministers of 10 September 2019 on projects that may have a significant impact on the environment (Journal of Laws of 2019, item 1839, as amended), Regulation of the Minister of Labour and Social Policy of 26 September 1997 on general occupational health and safety regulations (i.e. Journal of Laws of 2003 No. 169, item 1650, as amended), Regulation of the Minister of the Environment of 16 June 2009 on occupational health and safety in municipal waste management (Journal of Laws of 2009, No. 104, item 868), Regulation of the Minister of Internal Affairs and Administration of 19 February 2020 on fire protection requirements to be met by construction works or parts thereof and other places to be collected, storage or processing of waste and applicable acts of local law (PSZOK Regulations, Regulations for maintaining cleanliness and order in the Tuchów Commune and resolution on the detailed manner and scope of providing services in the field of collecting municipal waste from residential properties and managing this waste in exchange for a fee paid by the property owner for municipal waste management), along with executive acts.

3. The deadline for performance of the contract shall be set for the period from the date of conclusion of the contract, but not earlier than from 1 January 2024 to 31 December 2025.
