Description:
Promotion of the expansion and operation of a gigabit network for the development of the so-called light grey areas in areas of the district of Görlitz according to the profitability gap model

The aim of this tender (service concession) is to award grants for the development of previously underserved areas of the district of Görlitz with sustainable gigabit connections – so-called gigabit network – (network with very high capacity within the meaning of § 3 No. 33 TKG) for the development of the so-called "light grey spots" according to the profitability gap model. The entire project area is divided into a total of six lots (area lots)

Lot 1 "Bertsdorf-Hörnitz, Großschönau, Hainewalde, Jonsdorf, Leutersdorf, Mittelherwigsdorf, Olbersdorf, Oybin, Seifhennersdorf, Zittau"

The aim of this funding measure is to provide private households, companies and schools with gigabit Internet connections and corresponding services in the lot area as comprehensively and comprehensively as possible. At least the bandwidths shown in the tender documents must be achieved (actual availability at the so-called end point of line technology on the inside of the building wall is decisive).

The project is to be funded on the basis of the so-called economic gap model in accordance with No. 3.1 of the guideline "Funding to support the gigabit expansion of telecommunications networks in the Federal Republic of Germany" (Federal Funding Guideline) of 26.04.2021 as well as No. IV. of the Directive Digital Offensive Saxony of 18.09.2018, last amended by the Directive of 09.12.2019.

A preliminary market investigation has shown that a purely private-sector expansion of NGA broadband networks in the project area is not to be expected in the project area over the next three years. The aim of the support measure is therefore to remedy this market failure by closing the profitability gap by granting financial contributions of an appropriate amount. The profitability gap is defined as the difference between the present value of all revenues and the present value of all costs of building and operating the broadband network. The relevant earmarking period under subsidy law is seven years after completion and commissioning of the subsidised broadband network.

The amount of the grants is limited. The aim of the district is therefore to use the available funding to achieve the most comprehensive and high-quality supply possible for all private households and companies with broadband Internet connections and corresponding services at the respective minimum bandwidths. This is reflected in the relevant award criteria, which can be found in the tender documents.

Nevertheless, the implementation of the funding measure is subject to the proviso that the overall financing is secured. With the competition, neither the awarding authority nor the participating municipalities commit themselves to concluding contracts with the applicants. We reserve the right to award the contract if the broadband project proves to be unfeasible or financially viable for the economy as a whole. Such inefficiency is to be assumed in particular if the subsidies 3 / 15 announced by the federal government or the additional necessary state and own funds – regardless of the reason – cannot be conclusively acquired.

When selecting private telecommunications network operators, the contracting authority must take into account the requirements of budgetary and public procurement law, cf. para. 78c of the EU Guidelines on the application of the rules on state aid in connection with rapid broadband roll-out (2013/C 25/01) and § 6 in conjunction with § 5 para. 2 of the Gigabit Framework Regulation. Above all, it should be noted that the selection of the bidder to be favoured is in accordance with the spirit and principles of the EU Public Procurement Directives and German budget and procurement law. Therefore, the requirements and legal bases specified in the tender documents apply.

A subsidy agreement will be concluded with the successful bidders in this procedure, which, in addition to the expansion obligation, will also include the obligation to maintain network operation and the nationwide supply of all subscribers in the expansion area during the earmarking or contract period of at least seven years. The selected installer and operator of the NGA broadband network will also be obliged to provide the documentation obligations to be provided in accordance with the funding regulations.
