The subject of the contract is the delivery of a brand new set of forestry machines intended for harvesting and skidding manufactured not earlier than in 2023 to the place indicated by the Ordering Party, i.e. to the headquarters of the Cierpiszewo Forest District.
The subject of the contract must be brand new, unused, have all the necessary by law permits for use and admission to trading. A set of machines should consist of:
1) a brand new multifunctional feller and pruning machine – harvester
jednochwytakowego;
2) a brand new overhead skidder tractor – forwarder.
for the Cierpiszewo Forest District on the technical requirements and equipment described in detail in Annexes 2a and 2b to the SWZ.
3.1. Tangible scope of the item of the order
The subject of the contract is the delivery of a brand new set of forestry machines intended for harvesting and skidding manufactured not earlier than in 2023 to the place indicated by the Ordering Party, i.e. to the headquarters of the Cierpiszewo Forest District.
The subject of the contract must be brand new, unused, have all the necessary by law permits for use and admission to trading. A set of machines should consist of:
1) a brand new multifunctional feller and pruning machine – harvester

2) a brand new overhead skidder tractor – forwarder.
for the Cierpiszewo Forest District on the technical requirements and equipment described in detail in Annexes 2a and 2b to the SWZ.
1. The Contractor shall provide at least 24 months of warranty for the subject of the contract (in full months), counted from the date of signing by the parties the acceptance protocol of the subject of the contract without comments or from the date of removal of legal defects, hidden or difficult to determine physical defects.
2. The granted warranty covers all costs related to warranty repairs of the subject of the order, in particular: travel costs, labor, stay of service technicians, transport of the machine for service, brand new parts and materials approved by the manufacturer.
3. During the warranty period, the Contractor shall ensure periodic warranty inspections at the place where the machine is parked in accordance with the manufacturer's recommendations
4. The costs for warranty and subsequent inspections up to the amount of the first 6000 mtg (operating hours) of the machine, made in accordance with the recommendations of the machine manufacturer, shall be covered by the Ordering Party based on the price resulting from the Contractor's offer, in accordance with the conditions and scope of the guarantee.
5. The scope of the warranty does not cover: operating fluids, filters, belts, fuses, light bulbs, brake linings, unless their defects have been found justifying their replacement under the warranty.
6. In the case of replacement of parts during the warranty period with brand new ones, the Contractor shall provide for these parts the same guarantee as for the entire subject of the contract or manufacturer's warranty, if it would be more beneficial for the Ordering Party (the warranty starts on the day of acceptance of the repair).
7. The Contractor shall ensure that the parts and materials used during inspections and repairs will be brand new and original, in accordance with applicable regulations and standards
and norms in force in Poland and the European Union.
8. The Contractor shall ensure the availability of the warranty service 6 days a week
(Monday to Saturday excluding public holidays).
9. The Contractor shall remove the reported failure of the subject of the contract within the next 5 days of service operation, following the notification of the failure by fax or e-mail.
10. In exceptional circumstances, beyond the control of the Contractor, the Contractor has the right to apply to the Contracting entity before the date specified in point 9 with a justified request to extend the deadline for removing the failure of the subject of the contract by another 5 days of service operation. The final decision as to the recognition of the legitimacy of the application is the responsibility of the Ordering Party.
11. In the case of repairs not covered by the warranty by the service during its validity period, the Ordering Party shall cover the reasonable, agreed and accepted costs of parts, materials, travel to the subject of the order, labor and stay of service technicians.
12. As part of the rights in the scope of sales guarantee, the Ordering Party has the right to exchange the subject of sale for a new, identical or different one with technical parameters
and operating not lower than the parameters of the replaced machine, free from defects, if during the warranty period the subject of the contract will be repaired 5 times, and the machine will still show defects preventing its use as intended or the Contractor will make a statement in writing that it is impossible to remove the defect of the machine. In this case, the warranty and guarantee period will start to run from the moment of the protocol
