Attention:
Appendix 3 - Draft agreement - Amendments to the contract:
1. The Parties shall allow for the amendment of the contract:
1) in the event of circumstances specified in the provisions of law, including the Public Procurement Law, in particular in Article 455 of the PPL, on the principles set out in those provisions,
2) in the scope of replacement of products/products being the subject of delivery with replacement products/articles, while maintaining parameters and scope of application at least equivalent to the products/products being the subject of delivery and a unit price not higher than specified in this contract in the event of temporary or permanent unavailability of products/products specified in the contract, including in the event of cessation of production or withdrawal from the market of the product/product being supplied; The Contractor is obliged to prove the occurrence of the above-mentioned circumstances,
3) in the scope of replacing the products/products being the subject of the supply with replacement products/products, while maintaining the parameters and scope of application at least equivalent to the products/products being the subject of delivery and the unit price not higher than specified in this contract in the case of the introduction of a new product/product constituting the equivalent of the product/product being supplied,
4) replacement of the device being the subject of the lease / subject of rental in a situation where a modified (improved) product is introduced for sale by the Contractor, with the proviso that it may not cause deterioration of the parameters of the device and may not limit the scope of its application and will not increase the rental price,
5) exchange of the subject of rental for another with no worse parameters and scope of application in the event of a defect in the subject of rental, in a situation where replacing the subject of rental with the same subject is impossible or significantly difficult, or other justified circumstances occur, and if this does not increase the rental price.
6) in the scope of increasing the order, as part of the subject of delivery, the number of certain assortment items, while reducing the order of the number of other assortment items and maintaining unchanged the total value of the net subject of delivery, beyond the scope specified in §4 section 1, not more than up to 50% of the value of the net haulage item,
7) in the scope of extending the duration of the contract in the event of failure to perform the subject of the contract in full within the period specified in the contract; The total term of the contract, the duration of which has been extended, may not be longer than 48 months, with a corresponding decrease in the value of the subject of delivery and an increase in the rental value with the total net value of the contract unchanged.
2. The Parties allow for the possibility of reducing unit prices in the event of circumstances affecting the reduction of the price of the product/product being supplied.
3. If the Contractor's commercial offer includes an equivalent of any, several or all of the products/products being the subject of delivery with parameters not worse than those specified in the subject of the contract, with a price lower than the price of the products/products being the subject of delivery, the parties allow the possibility of replacing the product/product being the subject of delivery with a product/product with a lower price.
4. The Parties allow for the possibility of changing the amount of remuneration due to the Contractor in the event of a change:
a. rates of value added tax and excise duty,
b. the amount of the minimum wage for work or the amount of the minimum hourly rate determined on the basis of the provisions of the Act of 10 October 2002 on the minimum wage for work,
