3. The Ordering Party informs that the amount of waste given above is an estimated amount, illustrating the possible size of the scope of the subject of the contract and may change depending on the needs of the Ordering Party, while the Ordering Party provides a minimum total amount of waste at the level of approx. 300 Mg. Therefore, collection and management of waste in an amount lower than estimated above, i.e. 3 000 Mg, but not less than approx. 300 Mg does not give rise to any liability on the part of the Ordering Party, and the Contractor will not be entitled to claims in this respect.
4. Biodegradable waste with code 20 02 01 being the subject of the contract comes from selective collection of waste at source collected directly and through Selective Municipal Waste Collection Points (PSZOK). Before handing over the waste for transport, the Ordering Party shall fragment it. At the same time, the Contracting Authority stipulates that in exceptional cases, caused e.g. by downtime or failure of the shredder, the Contractor should collect waste without prior fragmentation. The Contractor will not question the quality of the collected waste, and therefore the Contractor may not refuse to collect and accept the above-mentioned waste for management.
5. Method of waste collection:
I. The Contracting Authority requires the Contractor to carry out the service of collection and management of biodegradable waste with the code 20 02 01 on an ongoing basis on working days from Monday to Friday, from 6:00 to 21:00 (ZZO Trzebania) with a frequency: min. 1 course per day.
At the same time, the Contracting Authority stipulates that the above-mentioned daily amount of waste collection should be adapted to the current needs of the Contracting entity in this respect, which means that the Contractor, at the request of the Contracting Entity, will provide an appropriate, smaller or larger number of courses on a given day / week than indicated above, in order to guarantee the current collection of waste. The required response time of the Contractor to the Ordering Party's notification may not exceed 24 hours from the moment the Contractor receives the notification by e-mail, counting working days.
II. For technical, technological and logistic reasons, the Ordering Party reserves the right to collect and transport any amount of waste by the Contractor, and thus does not provide transport batches.
III. Waste should be transported by the Contractor using vehicles such as: a tractor unit with a tipper semi-trailer or a walking floor with a permissible load capacity of min. 24 000kg and/or hooklift trucks for transporting containers with a capacity of approx. 30m3.
IV. Loading waste into the Contractor's cars using a loader is the responsibility of the Ordering Party.
