The subject of the contract is the provision of physical security services for persons and property. CODE CPV 79710000-4 - rendering services by the Specialized Armed Protective Formation (SUFO) in the scope of protection of persons and property in supply complexes in terms of security of JW 4929 in Dęblin, in a material system:
1) Direct physical protection of complexes:
1.1 Dęblin Airport (JW 4929);
1.2 Deblin Fortress (JW 3248);
1.3 Click (131krt, JW 3533);
1.4 Roskosz, Sidorki (7 krrel, JW 3411);
1.5 Roskosz (144 Oct, JW 3533);
1.6 Dęblin Composition (JW 4228);
2) Protection and monitoring of facilities:
2.1 of the Military Supplement Command (WKU) in Biała Podlaska;
2.2 of the Military Supplement Command (WKU) in Puławy;
2.3 Supervision of building No. 114 in Biała Podlaska.
3) Convoying of JW 4929 monetary values.
The subject of the contract includes 3 tasks:
Task No. 1 - providing services by the Specialized Armed Protective Formation (SUFO) in the field of protection of persons and property in supply complexes in terms of protection of JW 4929 in Dęblin and escorting monetary values:
1) Direct physical protection of Dęblin Airport complexes (JW 4929);
2) Convoying cash values of Dęblin Airport (JW 4929).
Task No. 2 - providing services by the Specialized Armed Protective Formation (SUFO) in the field of protection of persons and property in supply complexes in terms of protection of JW 4929 in Dęblin and escorting monetary values;

A detailed description of the subject of the contract is included in Annex 2 to the Specification of Essential Terms of the Contract and in the general conditions of the contract for individual tasks - Annexes 14a, 14b, 14c to the ToR
ATTENTION! Partial orders - The Employer allows submission of applications / partial offers for all parts of the contract (Article 36aa (2) of the Public Procurement Law).

2. Purpose of protection:
The main purpose of the security service is:
1) 24-hour physical protection of persons, property and objects in security zone III in the scope of: preventing burglary, theft and devastation;
2) limiting the effects of possible external threats resulting from:
- activities of organized criminal and terrorist groups,
- penetration into the military unit (complex, facility) of sabotage or subversive groups or individuals in order to damage, destroy or seize devices and equipment.
3) support for activities related to the protection of classified information, carried out by the security division in JW 4929, JW 3248, JW 3533, JW 3411 (7 krrel), JW 3533 (144 prdz), WKU Puławy and WKU Biała Podlaska and the Depot of Dęblin, protected through SUFO;
4) detention of the perpetrators of burglaries, theft, devastation of property and suspects
For committing a crime against health, life or property in a protected facility in order to immediately transfer these people to the Military Police or the Police;
5) cooperation with the Military Police, military law enforcement agencies and the police on the terms set out in separate regulations;
6) cooperation with the internal duty service of protected complexes;
7) handing over to the Police, Military Police or military order authorities of persons apprehended during the performance of protective tasks, in accordance with a specified procedure;
8) performing tasks specified by the Employer in accordance with the received extracts from the security plans JW 4929, JW 3248, JW 3533, JW 3411 (7 krrel), JW 3533 (144 prdz), WKU Puławy and WKU Biała Podlaska and the Dęblin warehouse, hereinafter referred to as extracts from the protection plan and "Instruction for the protection of the complex JW 4929, JW 3248, JW 3533, JW 3411 (7 krrel), JW 3533 (144 prdz), WKU Puławy and WKU Biała Podlaska and the Dęblin warehouse", hereinafter referred to as the protection instructions and tables of posts or instructions for the given complex / facility.
9) compliance with art. 14, 16, 17 of the Act of 26.10.1982 on upbringing in sobriety

4. Classified Information Protection (for all tasks):
1) On the basis of art. 131 f of the PPL Act, the contracting authority informs that in accordance with the Act
Of August 5, 2010 on the protection of classified information (Journal of Laws 2019, item 742, as amended), the Contractor is obliged to ensure the protection of classified information which he obtained during this public procurement procedure
In the fields of defense and security and after its termination (during and after the contract), in the manner specified in the regulations on the protection of classified information.
2) During the term of the contract and after its termination, the Contractor undertakes, under pain of criminal liability, to keep secret all information which he had during the provision of the security service.
3) Access to classified information related to the performance of the contract will only be available to persons who have a valid security clearance with the required clause or a valid authorization of the head of the organizational unit and who need this information to perform the subject of the contract, have received training
In terms of protecting classified information and are on the list provided to the Employer.
4) The Contractor undertakes to strictly comply with the provisions contained
In the "Industrial Safety Instruction" constituting Annex 1 to the contract.
5) At the request of the Employer, the Contractor shall allow the Proxy of Protection to carry out checks on the storage, preparation and circulation of related documents
With the service provided at the Contractor's headquarters.
6) In the event of disclosure of classified information, the Contractor undertakes to immediately:
a) inform the Employer of this fact and act in accordance with the Act on the protection of classified information;
b) suspend the employee responsible for disclosing the classified information in performing his duties;
c) conduct an investigation to clarify the circumstances of their disclosure;
d) change employees who disclose classified information.
7) In the event of a breach of the rules on the protection of persons and property by the Contractor, the Employer
He will notify the Military Police and the Administrative Proceedings Department of the Provincial Police Headquarters.
8) The contracting authority reserves the right to verify or remove contractors' employees who are to participate in the performance of the contract, both at the stage of conducting the public procurement procedure and at the stage of performance of the contract, if it is required to protect the basic interests of national security or it is necessary to increase the security of orders.
5. Requirements related to the performance of the contract in the fields of defense
And security to ensure the security of classified information (pursuant to Article 131g (1) of the Public Procurement Law):
1) Contractors are informed of their obligation to ensure the protection of classified information which they obtained during the award procedure of this contract in the fields of defense and security and after its termination,

2) The contractor and subcontractor are obliged to preserve the confidential nature of classified information in their possession or which they will become familiar with.

5) The contracting authority reserves the right to verify or remove contractor employees who are to participate in the implementation of this contract, both at the stage of the public procurement procedure and at the stage of the contract if it is required to protect the basic interests of national security or is it is necessary to increase the security of the order being processed.
6) Requirements for access to classified information
The contractor must demonstrate:
- the ability to produce, store, process and transfer classified information with the "RESERVED" clause at its headquarters in accordance with the requirements set out in the Act of 5 August 2010 on the protection of classified information (Journal of Laws of 2019, item 742, as amended). changes) and has at its headquarters an ICT system intended for the production, processing, storage or transmission of classified information with a minimum clause "RESERVED", organized in accordance with

6. The Contractor must agree to the implementation of security services after the announcement of mobilization, martial law or during the war in accordance with the "protection plans" developed by the Employer for the complexes and facilities of the Military Unit 4929, Military Unit 3248, Military Unit 3533 (Klikawa) Military Unit 3411 (7 krrel) and Military Unit 3533 (144 prdz), WKU and Depot Dęblin, after signing the contract, will immediately proceed to the procedure of extending the company to militarization on the terms and in the manner specified in the Regulation of the Council of Ministers of November 24, 2009 on the militarization of organizational units tasks for national defense or security (Journal of Laws No. 210 item 1612) and

Requirements for employment under an employment contract:
8.1. Acting in accordance with art. 29 paragraph 3a of the Act, the Employer requires employment on the basis of an employment contract throughout the entire period of implementation of the subject of the contract by the Contractor or Subcontractor of persons performing the following activities during the contract, the performance of which consists of performing work in the manner specified in art. 22 § 1 of the Act of June 26, 1974 - Labor Code:

a) direct physical protection of persons and property carried out by security officers at permanent and mobile posts and patrols,
b) service of the pass office,
c) tasks of the SUFO security commander carried out by security guards,
d) escorts.
For task No. 2
a) direct physical protection of persons and property carried out by security officers at permanent and mobile posts and patrols,
b) service of the pass office,
c) intervention group (external),
d) tasks of the SUFO security commander carried out by security officers,
For task No. 3
a) direct physical protection of persons and property carried out by security officers at permanent and mobile posts and patrols,
b) service of the pass office,
c) intervention group (external),
d) tasks of the SUFO Security Commander carried out by security officers.
8.2 The contractor or subcontractor is required to be employed under a contract

All persons who will participate in the performance of the task of protecting objects

In Biała Podlaska, the Contractor or Subcontractor is obliged to employ full-time employment contracts, the Employer leaves the Contractor with the form of employment in additional - extra-standard working time.
The method of verifying employment on the basis of an employment contract and sanctions for the Contractor:
8.3. During the performance of the contract, the contracting authority is entitled to perform inspection activities against the contractor regarding the fulfillment by the contractor or subcontractor of the employment requirement under the employment contract of the persons performing the activities specified in point 8.1. The Purchaser is entitled to:
1) demand statements and documents regarding confirmation of compliance with the abovementioned requirements and assessing them;
2) demand explanations in case of doubts as to the confirmation of compliance with the above. requirements;
3) carry out controls at the place of performance.
8.4. During the performance of the contract, the contractor will provide the contracting authority with:
1) on the day of signing the contract - certified as true copies by the Contractor or Subcontractor, respectively, copies of employment contracts of persons performing activities referred to in point 8.1 during the performance of the contract. Copies of contracts should be anonymized in a manner that ensures the protection of employees' personal data, in accordance with the provisions of the GDPR, the Act of May 10, 2018 on the protection of personal data (i.e. in particular without addresses, PESEL number of employees). The employee's first and last name are not anonymous. Information such as: date of the contract, type of employment contract
And the time dimension should be identifiable;
2) 2 days before taking up service by a given person - in the event of personal changes
During the performance of the contract - certified as true copies by the Contractor or Subcontractor, respectively, copies of employment contracts of persons performing activities referred to in point 8.1 during the performance of the contract. A copy of the contract should be anonymized in a manner that ensures the protection of employees' personal data, in accordance with the provisions of the GDPR, the Act of May 10, 2018 on the protection of personal data, i.e. in particular without addresses, PESEL number of employees). The employee's first and last name are not anonymous. Information such as: date of the contract, type of employment contract
And the time dimension should be identifiable;
3) at each call by the contracting authority within the time limit set out in the call, the contractor will submit to the contracting authority selected by the contracting authority from the evidence indicated below to confirm compliance with the employment requirement by the contractor or subcontractor of persons performing the indicated

- certificate from the competent ZUS branch confirming the payment of social security and health insurance contributions by the contractor or subcontractor on the basis of employment contracts for the last accounting period,
- a copy of the proof confirming the employer's registration for insurance, certified by the contractor or subcontractor, certified as true to the original, anonymized in a manner ensuring protection of employees' personal data, in accordance with the provisions of the GDPR and the Act of 10 May 2018.

8.5. Due to failure by the contractor or subcontractor to employ under the employment contract persons performing the activities specified in point 8.1, the contracting authority provides for a sanction in the form of the contractor's obligation to pay a contractual penalty
In the amount of PLN 4,000.00 for each identified case.
Failure by the Contractor to submit the requested evidence within the time limit set by the contracting authority to confirm that the Contractor or the Subcontractor has met the employment requirement under the employment contract will be treated as a failure by the contractor or subcontractor to employ under the employment contract for persons performing the activities specified in paragraph 8.1.
In the event of failure to fulfill the obligation indicated in point three times 8.4. The Employer has the right to withdraw from the contract and charge the Contractor an additional contractual penalty for withdrawing from the contract in the amount of 2% of the gross contractual remuneration.
8.6. In the event of justified doubts as to compliance with labor law, by the contractor or subcontractor, the contracting authority may request that the National Labor Inspectorate carry out an inspection.
9. On the basis of art. 131d. paragraph. Of the Act of 29 January 2004 - Public Procurement Law (consolidated text, Journal of Laws of 2018, item 1986, as amended), contractors with their registered office or place of residence in the area of defense and security may apply for one of the Member States of the European Union, the European Economic Area or a country with which the European Union or the Republic of Poland has concluded an international agreement regarding these contracts.
The Employer does not require the Contractor to perform key parts of the contract personally.
