1. The subject of the contract is the supply of brand new and complete spare parts for VW company cars
2. The contracting authority shall first examine and evaluate the bids, and then qualify the contractor whose bid has been rated the highest in terms of the lack of grounds for exclusion and the fulfilment of the conditions for participation in the procedure (Article 139(1) of the Public Procurement Act).
3. In connection with the application of the procedure under Article 139(1), the Contracting Authority does not require the submission of a statement referred to in Article 125(1) of the Public Procurement Law with the tender.
4. Pursuant to Article 257(1) of the Public Procurement Act, the Contracting Authority reserves the right to cancel the procedure.
1. The subject of the contract is the supply of brand new and complete spare parts for VW company cars.
2. A detailed description of the terms and conditions of the contract is specified in the model contract – Appendix No. 8 to the Terms of Reference.
3. The list of spare parts which are the subject of the contract is specified in the assortment and price form constituting Appendix No. 2 to the Terms of Reference. The quantities specified in the assortment and price form may not constitute the basis for claims on the part of the Contractor
in case of smaller needs of the Contracting Authority.
4. The Contracting Authority guarantees the performance of the contract in the amount of not less than 50% of the contract value.
5. The place of delivery is the Ordering Party's warehouses located in the following locations:
• in Łódź, 21/25 Stokowska Street
• in Piotrków Trybunalski, 30/38 Szkolna St.
• in Sieradz, 2 Sikorskiego Street.
6. The warehouses are open on working days from Monday to Friday from 8:00 a.m. to 3:00 p.m.
7. All costs of delivering spare parts to the destination, including insurance and transport costs, shall be borne by the Contractor.
8. The Ordering Party provides for the possibility of purchasing spare parts not listed in the assortment and price form for the following VW vehicle models:

9. The purchase of spare parts not listed in the assortment and price form may constitute no more than 40% of the contract value, provided that the price offered by the contractor is not higher than the average price of such parts of the same manufacturer at other distributors.
10. All costs of delivering the parts to the destination, including insurance and transport costs, shall be borne by the Contractor.
11. Orders will be placed successively by e-mail to the address provided by the Contractor.
12. The size of the ordered lots will result from the current needs of the Ordering Party.
13. The deadline for completing the order from the moment of notification cannot be longer than 2 working days.
14. The Ordering Party accepts both original and alternative parts, but requires that they are brand new, complete, free from technical and legal defects, admitted to the market and have a manufacturer's warranty.
15. The catalogue numbers in the assortment and price form have been given in order to specify the subject of the order and does not mean that the Ordering Party requires only spare parts with the indicated catalogue numbers, but also accepts substitutes.
16. Original parts (OE and OEM) are understood by the Ordering Party as parts whose quality corresponds to the quality of elements used in factory assembly
