1. The subject of the contract is the provision of electricity supply by the Contractor to the Ordering Authority for street lighting, buildings and facilities managed by Gmina Głogów Młp., EkoGłog company and other organisational units of the Municipality. This order does not cover electricity distribution services.
2. The supply of electricity will be carried out in accordance with the provisions of the Energy Law (text one. Journal of Laws of 2021, item 716, as amended) to the objects listed in Annex 1 to the SWZ.

5. The Contracting Authority obliges the Contractor to carry out the actions resulting
from the power of attorney annexed 2 to the draft contract, in particular to:
1) notification for the implementation of the contract concluded with the Contractor to sell electricity to the Distribution System Operator, make statements of will and determine on behalf of the Contracting Authority all necessary information in terms of termination of the existing sales contract electricity and the provision of distribution services (comprehensive agreement)
2) Conclusions on behalf of the Contracting Authority having a hitherto existing comprehensive agreement, distribution service contracts with the indicated Distribution System Operator, on the basis of the relevant power of attorney or a declaration of consent to the conclusion of a service contract distribution of electricity with the Distribution System Operator given by the Contracting Authority according to the model in force with the Contractor concerned, provided that the Contracting Authority, together with the signing of the contract (draft contract - Annex 3 to the SWZ), attaches the power of attorney or statement in question.
6. Before the conclusion of the contract, the Contractor is to hold an existing general agreement with PGE Distribution S.A., allowing the sale of electricity through the OSD distribution network to all facilities of the Contracting Authority, in accordance with Annex 1 to SWZ.
7. The Contracting Authority informs that, in connection with the nature of the contract, the exact consumption of electricity covered by the subject of the contract cannot be determined. For this reason, the Ordering Party submitted an estimated amount of electricity consumption. The Contracting Authority stipulates that the actual amount of electricity consumption may change, i.e. increase or decrease while maintaining the offered unit prices. Thus, the projected energy consumption described does not constitute an obligation for the Ordering Party to purchase energy at the specified amount.
8. The Ordering Party declares that he has the relevant legal titles and the right to purchase electricity to the facilities indicated in the proceedings.
9. At the request of the Contracting Authority, it is possible to increase or reduce the number of objects (points of collection) listed in Annex 1 to the SWZ. This change must not exceed 20% of the number of conscription points. Increasing the collection points or changing the tariff group is possible only within tariff groups that are included in the SWZ and valued in the Contractor's Offer Form.
