The subject of the contract is: Purchase of electricity for the municipality of Krzeszowice and organizational units of the municipality of Krzeszowice for the purpose of operating buildings, premises, utility facilities and powering street lighting within the meaning of the Energy Law (i.e. Journal of Laws of 2021, item 1093).

1. The subject of the contract is: Purchase of electricity for the Krzeszowice Municipality and organizational units of the Krzeszowice Municipality for the purposes of operation of buildings, premises, utility facilities and power supply of street lighting within the meaning of the Energy Law (i.e. Journal of Laws of 2021, item 1093), hereinafter referred to as the "purchase of electricity", for a period of 11 months (1.02.2024 – 31.12.2024).

2. The contract shall cover the purchase of electricity to the facilities listed in point 5 to SWZ:

1) The estimated electricity demand for the 11-month period is 2,943,532 kWh.

2) The performance of the activities arising from the power of attorney constituting Annex 2 to the draft agreement, and in particular the Contractor obliges the Contractor to notify the designated Distribution System Operator to implement the contract concluded with the Contractor for the sale of electricity, representing The Contracting Authority, to make statements of will and to determine on behalf of the Contracting Authority all necessary information regarding the change of the supplier of the sale of electricity.

3) The Ordering Party informs that

(a) the procedure for selecting an energy seller in the form of a tender shall take place once again;

(b) has contracts:

- for the distribution of electricity from the DSO - Tauron Dystrybucja S.A. – Branch in Kraków for an indefinite period of time;

- electricity purchase agreements with TAURON Sprzedaż Sp. z o.o. (valid until 31.01.2024),

c) the forecast of energy consumption indicated above and in the Description of the subject of the contract is only an approximate value, which may change during the performance of the contract, and the actual energy consumption (less or greater than the forecast indicated in Annex 8 to the SWZ) will depend only on the actual needs of the Ordering Party, and the Seller is obliged in each case to apply the energy prices offered in the tender;

d) agrees to the conclusion of the contract by correspondence;

e) the Contractor selected in the proceedings, will provide PPE data in electronic form, immediately after the conclusion of the contract;

f) meets the conditions set out in the Act of Denmark of 27 October 2022 on emergency measures aimed at limiting electricity prices and support for certain customers in 2023.

g) The Ordering Party does not have comprehensive agreements and does not use promotional offers.

3. The scope of the contract includes the sale of electricity:

- for the Municipality of Krzeszowice: street lighting 2,158,372.00 kWh - 168 points

- for the Municipality of Krzeszowice: other facilities 239,448.00 kWh - 29 points

- for Organizational Units: 545,712.00 kWh - 10 units - 51 points:

Pursuant to Article 38 of the PPL, the proceedings are conducted jointly. The Municipality of Krzeszowice conducts these proceedings on its own behalf (as the Contracting Authority) and the following Contracting Authorities:
