The contract relates to the supply, even in split form, of alleged kg. 379 600 of plastic film reels, having the characteristics indicated in the technical specification, to be carried out at the waste shredding and packaging (STIR) plants managed by this single shareholder Provincia di Napoli SpA environmental system.
The contract relates to the supply, even in split form, of alleged kg. 379 600 of plastic film reels, having the characteristics indicated in the technical specification, to be carried out at the waste shredding and packaging (STIR) plants managed by this single shareholder Provincia di Napoli SpA environmental system. The characteristics of the supply and the detail of the presumed quantities of the plastic film reels are better described in the technical specification. The services deducted in the contract, due to their homogeneity, do not allow the subdivision into main and secondary services. The duration of the contract is set at 12 months from the effective commencement date of the supplies, which must result from a specific report drawn up in contradictory form, unless the related amount is exhausted before the contractual expiry.
The customer is entitled to activate the options, the details of which are reported in art. 3) of the special tender specifications.
It is represented that art. 14, paragraph 3 of the regional law 5.4.2016 n. 6, published in the official bulletin of the Campania Region n. 22 of 5.4.2016, established that "in the transitory phase of reorganization of the waste cycle, pending the assignments that will be arranged by the government bodies in the optimal areas, the activities attributed to the provincial companies in accordance with current regulations continue". Therefore, the client will continue to carry out its institutional activity, on the basis of the regulatory provisions, until the possible identification of a new service manager.
Having said this, it is understood that this tender procedure is subject to the provisions of art. 40 of LR n. 26.5.2016, n. 14, published in BURC n. 33 of 26.5.2016, therefore, the identification by the local authority of the new integrated service manager determines the express and automatic termination of the assignment. The new operator of the service will have the right to continue or not to continue in the activities relating to the contract.

The start of supplies is expected, presumably, for 1.5.2020.
The RUP may authorize, once the definitive award has become effective, the early execution of the services covered by the contract, pursuant to art. 32, paragraphs 8 and 13 of Legislative Decree 50/2016.
