1. The subject of the contract is the supply of various foodstuffs, spices and herbs as well as powdered soups, white sugar, fats and chicken eggs to the Police School in Katowice for a period of 5 months.
2. The full list of assortment being the subject of delivery and the maximum quantity of ordered products is given in the assortment-quantity-value specification constituting Annex 1A, 1B, 1C, 1D to the SWZ.
3. The Ordering Party reserves the option of not fulfilling the subject of the contract worth up to 50% of the total gross remuneration. No financial or legal claims are entitled to the Contractor's part of the contract.
4. Delivery, unloading and delivery will be made at the Contractor's expense calculated in the price of the products covered by the contract.
5. Delivery of the object of the order shall be carried out by means of transport of the Contractor authorized for the transport of food

Failure to complete column No. 3 of the above-mentioned specification (Annex 1A) or proposing products inconsistent with the requirements of the Ordering Party will be tantamount to rejecting the Contractor's offer pursuant to Article 226(1)(5) of the PPL Act – as inconsistent with the terms of the contract.
4. The given quantities are estimates and do not oblige the Ordering Party to purchase products in these quantities.
5. The Contracting Authority reserves the possibility of not fulfilling the object of the order worth up to 50% of the total gross remuneration No financial and legal claims are entitled to the Contractors due to the failure of fulfilment of part of the contract.
6. Delivery, unloading and placing of the object of the contract shall be carried out at the expense of the Contractor as calculated in the price of the products covered by the public contract award contract.

In order to confirm that the offered deliveries meet the specified requirements, the Ordering Party requests the Contractor to submit product cards or other documents together with the offer, from which their composition and fulfillment of the requirements specified by the Ordering Party in the Assortment-quantity-value Specification constituting:
1) For part 1 – Annex 1A to the SWZ – in headings: 1, 2, 7, 8, 9, 10, 13, 14, 25, 26, 27, 31, 33, 41, 42, 43;
9. Persons performing the delivery must have a current medical certificate for sanitary and epidemiological purposes, which they present at the request of the Ordering Party.
10. The contractor shall be obliged to have a current certificate of entry in the register of establishments subject to official control by the competent authority or of a current administrative decision on entry in the register of establishments or on approval of an establishment issued by the district veterinarian together with an identification number. The contractor must be subject to constant supervision by the competent authority.
11. The products offered must meet the requirements set out in the applicable legislation on the production and marketing of food. Each product must be manufactured and placed on the market in accordance with the requirements of the HACCP system.
12. The details of the delivery are specified in the model contract constituting Annex 5 to the SWZ.
