1. The subject of the contract is the implementation of the investment entitled Construction of a pedestrian and bicycle footbridge "Kazimierz – Ludwinów", which includes the performance of all works and other relevant activities required by the content of issued decisions or arrangements, and related to the construction and putting into use (including obtaining a decision on the occupancy permit) a complete building object – a pedestrian and bicycle footbridge "Kazimierz – Ludwinów", along with utilities and land development of the plot Investment.
2. A detailed description of the subject of the contract and the scope of the Contractor's obligations are specified in the annexes to the SWZ, including, m.in. in the Draft provisions of the contract (PPU) and documents indicated in the List of documents describing the subject of the contract.

3.The contracting authority, in accordance with Article 139 paragraph 1 of the PPL, provides for a reverse sequence of activities, i.e. first it will examine and evaluate the bids, and then it will make a subjective qualification of the Contractor whose bid was the highest scored, in terms of the lack of grounds for exclusion and meeting the conditions for participation in the procedure. In connection with the application of the above procedure, the Contracting Authority does not require submitting a statement in the form of a European Single Procurement Document (ESPD) together with the offer. The Contracting Authority requests this statement only from the Contractor whose offer was rated the highest.

5.The Contracting Authority informs that it has received the Initial Promise from the Government Fund Polish Governance: Strategic Investment Program for the implementation of this investment.
6. The Contracting Authority requires the Contractor or Subcontractor to employ persons on the basis of an employment relationship. The requirements for employment on the basis of an employment relationship referred to in Article 95 of the PPL Act are set out in the PPU, constituting an annex to the SWZ.
7.The Contracting Authority shall not require the Contractors to submit the said means of evidence.
8.Before concluding the contract, the Contractor whose offer has been considered the most advantageous is obliged to lodge a performance bond in the amount of 5% of the total price specified in the offer (price for the performance of the entire subject of the contract).
9. The contracting authority provides for the award of contracts referred to in Article 214(1)(7) of the PPL, which repeat a similar subject of the contract to this contract up to PLN 25 000 000 net. The Contracting Authority provides for the possible conclusion of contracts consisting in the repetition of construction works (construction works, installation works, land development) within a period of 3 years from the date of award of the basic contract, and the determination of the Contractor's remuneration will take place after prior negotiations with the Contractor. The basis for determining the amount of remuneration for the execution of these construction works will be the cost estimate prepared by the Contractor. To determine the unit price of works included in the cost estimate, average prices and indicators R (labour), M (material price), S (equipment labour costs), Ko (overhead costs) and Z (profit) from the latest published Sekocenbud issues will be used. To determine the price of materials and equipment not published in Sekocenbud notebooks, the Contractor shall present a price based on data resulting from the market research carried out by the Contractor and approved by the Contracting Authority.
