The subject of the contract will include the delivery of flexible shape memory posts divided into zones of the city of Łódź to the place indicated by the Ordering Party. Delivery and unloading of the subject of the contract described in paragraph 1 shall take place at the expense of the Contractor at the place indicated by the Contracting Authority, within the administrative boundaries of the city of Łódź. The risk of loss of the subject of the contract, its damage or destruction during transport shall be borne by the Contractor.
The Parties agree that for the performance of the subject of the contract, the Ordering Party shall pay remuneration determined on the basis of the unit prices specified in the price form and the quantities of deliveries actually made and received.
The Ordering Party reserves the right to make quantitative changes in individual items listed in the Price Form and adapt them to the actual needs of the Ordering Party.
Expected number of flexible posts: for the area in the Metropolitan Zone – 240 pieces, for the area outside the Metropolitan Zone – 400 pieces.
The order must be completed from the date of conclusion of the contract until 30 September 2025 or until the maximum remuneration of the Contractor is exhausted, whichever occurs first. The subject of the order will be executed successively on the basis of written orders of the Ordering Party transmitted electronically or by fax, specifying the quantity and type of ordered materials and the place of delivery. These orders will form an integral part of the contract. The deadline for the execution of a particular order is 60 days and is counted from the day following the date of transmission of the order.
THE INFORMATION CLAUSE FROM ARTICLES 13 AND 14 OF THE GDPR is included in point 39 of the SWZ
(SWZ compliant number) 23.1 The Contracting Authority shall request the Contractor to pay a deposit in the amount of: PLN 21,600.00 (in words: twenty-one thousand six hundred 00/100). 23.2 The bid bond shall be lodged before the deadline for submitting offers and shall be maintained continuously until the expiry of the bid validity period, except for the cases referred to in Article 98(1)(2) and (3) and Article 98(2) of the PPL.
24.1 The Contractor whose offer has been selected is obliged to lodge a performance bond in the amount of 5% of the total gross price specified in the offer. 24.2 The security is used to cover claims for non-performance or improper performance of the contract.
