1. The subject of the contract is a comprehensive supply of gaseous fuel – supply of high-methane natural gas with the symbol E along with a distribution service. The projected amount of gaseous fuel is 70,859,312 kWh (using a conversion factor of 11.4 – 6,215,733 m3), of which:
1) Lot 1 of the contract - Comprehensive supply of natural gas in 2024 – 38,067,055 kWh
2) Lot 2 of the contract – Comprehensive supply of natural gas in 2025 – 32,792,257 kWh.
The above data are indicative. The contractor should take into account possible fluctuations in collection. Reducing or increasing the amount of gaseous fuel does not entail any consequences for the ordering party (recipients), except for the need to pay for the amount of gas actually taken and transmission services in accordance with the applicable DSO Tariff.
2. The proceedings covered PPGs in which customers are "subject to tariff protection", those referred to in Article 62b(1)(2) of the EP Act, and customers who are not protected.
Comprehensive supply of natural gas in 20241. A detailed list of PPG is attached as Appendix 1a to the Terms of Reference.
2. Estimated amount of natural gas – 38,067,055 kWh.
3. Quantity of PPG - 197.
4. Delivery period: from 01.01.2024 until 31.12.2024
5. Number of contracts – as a result of the outcome of the procedure, 16 contracts will be concluded.
6. Quality standards: The Contracting Authority informs that the quality standards for the supply of natural gas relating to all essential features of the subject matter of the contract describe and regulate:
1) The subject of the contract are the supply of high-methane natural gas via the distribution network of Polska Spółka Gazownictwa sp. z o.o. with quality standards specified in accordance with applicable regulations, along with the transmission service. Deliveries and distribution services provided on the basis of a comprehensive agreement will be performed under the conditions set out in the provisions of the Pe Act and the implementing provisions of the Act and in accordance with the provisions of the DSO Tariff.
2) The quality parameters of gaseous fuels are regulated by the provisions of the Energy Law, executive acts, in particular the Regulation of the Minister of Energy of 15 March 2018 on the detailed rules for the formation and calculation of tariffs and settlements in trade in gaseous fuels, amended by the Regulation of the Minister of Energy of 22 September 2019 amending the Regulation on the detailed rules for the formation and calculation of tariffs and settlements in trade in gaseous fuels (consolidated text Journal of Laws of 2021, item 280), Regulation of the Minister of Economy of 2 July 2010 on the detailed conditions for the operation of the gas system amended by the Regulation of the Minister of Climate and Environment of 6 August 2022 amending the Regulation on the detailed conditions for the operation of the gas system (Journal of Laws of 2022, item 1899) and Polish Standards.
3) Tariff for gaseous fuel distribution services
7. The proceedings covered PPGs in which customers are "subject to tariff protection", i.e. customers referred to in Article 62b(1)(2) of the EP Act and customers who are not protected. In Appendix 1a to the Terms of Reference, the contracting authority indicated to which PPG the provisions of Article 62b apply and according to which percentage.
8. On the basis of the Power of Attorney granted, the Contractor will be obliged to submit a DSO agreement on behalf of itself and the contracting authority in accordance with the applicable regulations and to represent the DSO before the DSO in the process of changing the seller.
9. The contracting authority reserves the right to use Article 139(1) of the PPL, i.e. the possibility of first examining and evaluating bids, and then selecting the contractor whose bid was rated the highest in terms of the lack of grounds for exclusion and meeting the conditions for participation in the procedure.
10. Sanctions Act – the Act of 13 April 2022 on special solutions for counteracting support for aggression against Ukraine and for the protection of national security (Journal of Laws of 2023, item 1497).
11. The Contracting Authority requires the payment of a tender deposit for Lot 1 of the contract in the amount of PLN 170,000.00.

Deliveries and distribution services provided on the basis of a comprehensive agreement will be performed under the conditions set out in the provisions of the Pe Act and the implementing provisions of the Act and in accordance with the provisions of the DSO Tariff.
