Description:
Subcontracting services for the KRZN

The Ministry of School and Education of the State of North Rhine-Westphalia (“MSB”) supervises the entire school system for the state of North Rhine-Westphalia (“State of North Rhine-Westphalia”), consisting of around 5,700 schools, approximately 200,000 teachers and 2.5 million students. One of the MSB's main tasks is to secure and further develop a high-quality, future-oriented, internationally competitive educational offer in schools. The main focus here is on digitalization.

Against this background, the MSB is implementing the LOGINEO NRW project, a digital work and communication platform that aims to further implement digitalization in schools in the state of North Rhine-Westphalia. A specially developed software solution based on open source components is intended to provide teachers and students with a web-based environment and an app that offers access to several applications after a one-time registration (single sign-on). Teachers can communicate in a legally secure manner via business e-mail addresses, organize appointments in shared calendars and exchange materials in a protected area. In the future, third-party products such as (digital) learning materials will also be connected. It is planned to offer these services to students as well.

The KRZN is now looking for a strong partner who will participate in the tender as a subcontractor of the KRZN and, if the order is placed, executes the order together with the KRZN.

As a contracting authority, the KRZN is obliged to tender subcontractor services in accordance with Section 99 No. 2 GWB in accordance with public procurement law. Since the bidders in the MSB tender (“MSB tender”) must name the subcontractors to be used for order execution before the bidding talks (presumably in the 14th calendar week 2022), the KRZN must have completed this procurement procedure via the subcontractor order in good time before this date.

With announcement dated December 22, 2021 (2021/S 248-656832), the state of North Rhine-Westphalia, represented by the MSB, is announcing the operation and 2nd and 3rd level support for LOGINEO NRW (“main order”) throughout Europe by means of a negotiated procedure with participation competition (“MSB tender”). The KRZN is applying for the main contract as an individual bidder and submitted its application for participation, including all declarations and proofs required by the MSB, in due time on 27.01.2022.

The KRZN is now looking for a partner who participates in the tender as a subcontractor of the KRZN and, if the order is placed, executes the order together with the KRZN. As a contracting authority, the KRZN is obliged to tender subcontractor services in accordance with Section 99 No. 2 GWB in accordance with public procurement law. Since the bidders must name the subcontractors to be used for order execution in the MSB tender before the bidding talks (probably in the 14th calendar week 2022), the KRZN must have completed this award procedure via the subcontractor order in good time before this date.

In the context of operations and 2nd/3rd level support operations, the following services are to be provided in particular: One-time migration of data from the school platform including associated peripheral systems, the learning management system and software tools for further development (Jira and Confluence) to those to be operated by the KRZN/subcontractor Systems; operation of all applications or software products required to provide the overall functionality of LOGINEO NRW; provision and operation of the cloud infrastructure required for LOGINEO NRW applications and other infrastructure components required for this. Optionally, the order also includes operation and 2nd and 3rd level support as well as the maintenance of a new LOGINEO website. The performance period of the subcontractor order begins with the award in this subcontractor tender. The services that the subcontractor has to provide from the time the contract was awarded and during the current MSB tender are defined in more detail in the subcontractor contract. In addition, the service period of the subcontractor order corresponds to the performance period of the main order and ends at the latest at the end of nine years from the start of the contract period of the main order (36 months standard term with three extension options of two years each).
