The subject of the contract are services in the field of forest management in accordance with the definition in Article 6(1)(1) of the Act of 28 September 1991 on forests (consolidated text: Journal of Laws of 2021, item 1275, as amended – "Act on Forests") covering breeding works to be carried out in the Cisna Forest District in 2022. The procedure shall be conducted in accordance with the rules laid down for classic contracts with a value equal to or exceeding the Union thresholds. The proceedings are conducted in accordance with the rules provided for the so-called "reverse procedure" referred to in Article 139(1), (3) to (4) of the Public Procurement Law. In accordance with the aforementioned provisions, the Contracting Authority will first examine and evaluate the offers, and then make a subjective qualification of the Contractor whose offer has been rated the highest, in terms of the lack of grounds for exclusion and meeting the conditions for participation in the procedure.
Package I – forestry: ŻubraczeThe subject of the contract are services in the field of forest management in accordance with the definition in Article 6(1)(1) of the Act of 28 September 1991 on forests (consolidated text: Journal of Laws of 2021, item 1275, as amended – "Act on Forests") including works in the field of forest breeding (early cleaning (CW-W) and late cleaning (CP-W)) to be performed in the Cisna Forest District in 2022 - Żubracze Forestry. The material scope of the subject of the contract includes the total quantities of work in the field of breeding resulting from Annex 3 to the SWZ, which consists of: Appendix No. 3.1. – size of works by groups of activities, activities and locations. The material ranges listed in Annex 3.1 are estimates. Quality standards relating to all essential features of the subject of the contract are specified in Decision No. 19 of the General Director of the State Forests of 17 March 2021 on the introduction of the "Description of the standard of forestry work technology" in organizational units of the State Forests. The detailed description of the standard of technology for performing individual forest works (activities) included in the subject of the contract specified in this decision was the basis for determining the quality requirements relating to the elements constituting the subject of the contract contained in Annex 4 to the SWZ (Description of the standard of technology for forestry work). Descriptions of activity codes describing individual forest works (activities) included in the subject of the contract are described in Appendix No. 4 to the SWZ. A description of the rules of the procedure for the acceptance of forest works is included in Annex 4 to the SWZ. The regulations that the Contractor will be obliged to comply with in particular during the implementation of the subject of the contract are described in point 3.2. SWZ. The Ordering Party does not reserve the obligation of the Contractor to personally perform key tasks regarding the subject of the contract. The Contractor may entrust the implementation of elements (parts) of the subject of the contract to subcontractors. Pursuant to Article 95 of the Public Procurement Law, the Contracting Authority requires the Contractor or a subcontractor to employ persons performing activities in the scope of contract performance consisting in obtaining and skidding wood raw material, if the performance of these activities consists in performing work in the manner specified in Article 22 § 1 of the Act of 26 June 1974 - Labour Code (consolidated text: Journal of Laws of 2020, item 1320, as amended. died.). The contracting authority provides for the possibility of awarding contracts referred to in Article 214(1)(7) of the Public Procurement Law within a period of 3 years from the date of award of the basic contract. The material scope of services constituting the subject of the contracts referred to in point 214(1)(7) of the Public Procurement Law shall not exceed 50% of the value of this contract. The proceedings are conducted in accordance with the rules provided for the so-called "reverse procedure" referred to in Article 139(1), (3) to (4) of the Public Procurement Law. The Ordering Party does not demand the provision of a security for the proper performance of the contract. The Ordering Party does not request a security deposit.
