The subject of this procedure is the assignment of the management of the territorial educational assistance service for school integration in favor of pupils in situations of severe psycho-physical disability (to pursuant to Law 104/92 art. 3 c.3) and of pupils in a situation of disability referred to in art. 3 co. 1 law 104/92 in special cases reported by social services, attending kindergartens, schools primary and secondary of the first degree, located in the municipal territory and resident in the Municipality of Rieti. The reference school years are as follows: 2021/2022 — 2022/2023 — 2023/2024.

The service in question is one of those classified in Annex IX of the Code of Public Contracts, therefore the application of Chapter II of Legislative Decree no. 50/2016 is determined for the procurement procedure itself in accordance with the provisions of Articles 142 and 143.

Since this is a confidential contract pursuant to art. 143 of Legislative Decree 50/2016, social enterprises that meet the conditions set out in paragraph 2 of the mentioned article are admitted to the tender:

-that have as their statutory objective the pursuit of a public service mission linked to the provision of the services referred to in paragraph 1 of art. 143 of Legislative Decree 50/2016;

- that they reinvest the profits in order to achieve the objective of the organization, or, if they distribute or redistribute the profits, and this is done on the basis of participatory considerations;

- whose management or ownership structures are based on employee or participatory ownership principles, or require the active participation of employees, users or stakeholders.

-Type A Social Cooperatives and their Consortia or RTIs referred to in Law 381/1991, which are entitled to the qualification of social enterprises.

Operators must be in possession of the qualification requirements required by the Call for Tenders and the Disciplinary.
