1. The subject of the contract is the maintenance of internal roads in the city of Gliwice.

1) The subject of the contract are works related to the maintenance of roads, streets, pavements, engineering structures and other devices and structures related to the network of internal roads for which the manager is the City of Gliwice.

2) The contract referred to in point 1) will consist in performing comprehensive and partial repairs, generally works that do not require a decision on the construction of all kinds of road surfaces, streets, pavements, drainage, ditches, engineering structures and maintenance, cleaning and other works in order to maintain safety on the managed road network.

3) The works will be carried out on the basis of the "Construction Law" Act (i.e. Journal of Laws of 2021, item 2351, as amended).

(1) In particular, the subject matter of the contract shall include:

a) Performing all necessary technical procedures to maintain good technical condition of the managed road network,

b) Ad hoc and final elimination of threats arising on the managed road network after preliminary agreement with the Ordering Party,

c) Maintaining a technical emergency service 24 hours a day on working days, holidays and holidays,

d) Protection of reported damage (e.g. defects in road surfaces and pavements) threatening public safety within a maximum of 1 hour and their removal within 72 hours from the moment of receiving information from the Ordering Party about their occurrence.

2) Typical works provided for the performance of the contract are described in the Table of Settlement Elements (TER) constituting Annex 3 to the contract and Annex ... to SWZ.

3) Works should be carried out in accordance with the terms of the Technical Specifications for the Execution and Acceptance of Construction Works constituting ANNEX 2 to the contract (Annex No. ..... to SWZ).

4) In addition to the above, the Contractor will be obliged, inter alia, to the following activities, which are not subject to separate payment, and their costs should be included in TER unit prices (overhead costs):

a) storing and keeping records on the basis of current weighing of granite cubes and other stone materials owned by the City of Gliwice and other materials from demolitions in the city, and suitable for re-development, for the duration of the contract,

b) storing and keeping records on the basis of current weighing and processing of asphalt destruct (property of the City of Gliwice) until re-incorporation into the surface [in accordance with the Environmental Protection Law (i.e. Journal of Laws of 2022, item 2556, as amended) and the Waste Act (i.e. Journal of Laws of 2022, item 699, as amended)],

Note: The demolition materials stored by the Contractor listed in points a) and b) will come from works performed under this contract and other investment works carried out by the Contracting Entity.

c) transport of the demolition materials collected so far and constituting the property of the Ordering Party (described in point 2.4.2. OST) from the existing storage yard to the Contractor's storage yard.

(d) execution of traffic organisation projects for the duration of the works and their approval by the traffic management body (if necessary),

e) marking the road lane and securing access and access to the property and detours for the duration of the works,

f) emergency protection of damage to the road lane and in the event of a failure related to the external device (network) will notify the appropriate network operators and maintain the marking until the network administration unit takes over the place of failure,

g) arrangements related to road closures (detours), including the conclusion of appropriate agreements with carriers (e.g. ZTM) for the duration of the works,

h) commissioning industry supervision over underground utilities networks,

i) performing load-bearing capacity tests of the substructure and surface, control boreholes, expert opinions for embedded materials, tests confirming the quality of performed works,

j) removal of soil and debris from construction sites and other materials and impurities to the landfill (required proof of disposal to the landfill at the request of the Ordering Party),

k) geodetic service of the construction site,

l) preparation, at the request of the Contracting Authority, of design documentation in the scope and form necessary to submit a notification of construction works to the competent public administration bodies,

m) as-built geodetic documentation with application to resources - if necessary.
