5.4. The Contracting Authority provides for the exclusion of the contractor:
5.4.1. pursuant to Article 109(1)(4) of the Public Procurement Law, i.e. in respect of which liquidation has been opened, bankruptcy has been declared, whose assets are managed by a liquidator or a court, has entered into an arrangement with creditors, whose business activity is suspended or is in another such situation resulting from a similar procedure provided for in the regulations of the place where the procedure was initiated.
5.5. In the case of joint bidding by contractors, the contracting authority shall examine whether there are grounds for exclusion for each of these contractors.
5.6. Meet the conditions for participation in the procedure set out in Article 112(2)(2) of the Public Procurement Law regarding the right to conduct a specific business or professional activity, provided that it results from separate regulations:
The Contracting Authority will consider the condition to be fulfilled if the Contractor demonstrates that it has the right to perform a specific activity or activity, if it has a permit to trade in medicinal products in accordance with the Act of 6 September 2001. 5.7. In the case of Contractors jointly applying for the contract, the Contracting Authority shall require that at least one of the Contractors meets the condition specified in section 5.3. The conditions set out in points 5.1 and 5.2 should be met by each of the contractors jointly applying for the contract independently.
5.8. With regard to the conditions relating to the right to carry out a particular economic activity, the contractors jointly applying for the award of the contract may rely on the entitlements of those economic operators who will carry out the supplies for which those licences are required. In such a case, the contractors jointly applying for the award of the contract shall attach to the tender a statement which shows which supplies will be made by each contractor – template statement Appendix No. 169 to the Terms of Reference.
5.9. In the case of joint bidding by contractors, the contracting authority shall examine whether there are grounds for exclusion for each of these contractors and whether they meet the conditions for participation set out in the procedure.
5.10. In an open tender procedure, in accordance with Article 139 of the Public Procurement Act, the Contracting Authority shall first examine and evaluate the bids, and then examine whether the contractor whose bid has been assessed as the most advantageous is not subject to exclusion and meets the conditions for participation in the procedure.
