The subject of this contract is the purchase of electricity for the needs of street lighting and selected objects within the administrative boundaries of the municipalities of Pszczyna, Pawłowice, Goczałkowice-Zdrój, Miedźna, Pszczyna Pszczyński, GOK in Goczałkowice-Zdrój, GZGK in Miedźna, MPBP in Pszczyna, PORT Pszczyna, PUP Pszczyna. ARiPZP Sp. z o. o. PTBS Sp. z o. o. and PIK Sp. z o. o. in accordance with the provisions of the Energy Law of April 10, 1997 (hereinafter: PE) by the Employer to its buildings and its infrastructure (in accordance with its authorizations) or to the infrastructure in which the Employer is a party to the distribution agreement. This order does not include electricity distribution services. The quality parameters of electricity are specified in the Ordinance of the Minister of Economy of 4.5.2007 on detailed conditions for the operation of the power system. The order includes the sale of energy in the period from 1.1.2019 to 31.12.2019.

The subject of this contract is the purchase of electricity, in accordance with the provisions of the Act of 10.4.1997 Energy Law (hereinafter: PE) by the Employer for its buildings and its infrastructure (in accordance with its authorizations) or to the infrastructure in which the Employer is a party to the contract distribution. This order does not include electricity distribution services. The quality parameters of electricity are specified in the Ordinance of the Minister of Economy of 4.5.2007 on detailed conditions for the operation of the power system.

The Purchaser informs that:

- during the term of the contract regarding the contract in question, the Employer will carry out the contract depending on the needs of the Employer, which cannot be determined precisely. Thus, the Employer does not guarantee the use of 100% of the volume specified in Annexes No. 1a, 1b, 1c, 1d, 1e, 1f, 1g, 1h, 1i, 1j, 1k, 1L, 1Ł to SIWZ. The Contractor is not entitled to any financial or legal claims in this respect. In relation to the entities indicated in Annex 1 to the ToR, the Employer guarantees that he will carry out the order at a level not lower than 60% of the volume specified in Annexes 1a, 1b, 1c, 1d, 1e, 1f, 1g, 1h, 1i, 1j , 1k, 1L, 1Ł to SIWZ,

- as a result of concluding new distribution service agreements or in economically justified situations for the Employer, some of the parameters listed in Annexes 1a, 1b, 1c, 1d, 1e, 1f, 1g, 1h, 1i, 1j, 1k, 1L, 1Ł, may Change. This situation may apply to contracted capacity or tariff (technical reasons), but the change may only be made within the tariff groups included in the subject of the order,

- the estimated electricity consumption from Annexes 1a, 1b, 1c, 1d, 1e, 1f, 1g, 1h, 1i, 1j, 1k, 1L, 1Ł was made with due diligence, however it is indicative,

- for connection points listed in Annexes 1a, 1b, 1c, 1d, 1e, 1f, 1g, 1h, 1i, 1j, 1k, 1L, 1Ł the role of the Distribution System Operator (hereinafter: DSO) is performed by the enterprise: Tauron Dystrybucja

- the role of electricity seller for connection points listed in Annexes 1a, 1b, 1c, 1d, 1e, 1f, 1g, 1h, 1i, 1j, 1k, 1L, 1Ł, is performed by the electricity trading company: PGE Skarżysko-Kamienna

The contractor must have concluded and binding contract, the so-called General Distribution Agreement, with a local DSO, based on which it may sell electricity through the distribution network of this DSO to all of the Employer's facilities indicated in Annexes No. 1a, 1b, 1c, 1d, 1e, 1f, 1g, 1h, 1i, 1j, 1k, 1L, 1Ł to SIWZ.

A detailed list of points serviced by which DSO and energy trading company will be provided by the Employer to the Contractor of these proceedings after signing the sales contracts in accordance with the template of Annexes 2a, 2b, 2c, 2d, 2e, 2f, 2g, 2h, 2i, 2j, 2k, 2L, 2Ł
