1. The subject of the contract is the wholesale sale and delivery of diesel oil in the amount of approx. 160 m3 carried out by the Contractor to the fuel tank located: Rzędów 40, 28-142 Tuczępy, owned by the Ordering Party:
- the quantities indicated are illustrative,
- during the term of the contract, the quantities indicated may be altered both by increase or decrease, provided that the amount indicated in the contract is not exceeded,
- The Ordering Party is not obliged to make full use of the indicated quantity.
A detailed description of the subject matter of the contract is included in the Description of the Subject of the Contract – Appendix No. 8 of the Terms of Reference.
Remark! The estimated quantity of fuel ordered is determined on the basis of consumption in 2022 and part of 2023, it is only indicative for comparing offers, and in no case does it constitute an obligation on the part of the Ordering Party to purchase fuels in the specified quantity. The Contractor shall not be entitled to any claim against the Contracting Authority for failure to collect the

2. The order in question must be executed in accordance with the applicable regulations and the terms and conditions contained in the Terms of Reference.
3. The Contracting Authority does not require:
- the Contractor has carried out an on-site inspection or,
- checking by the Contractor the documents necessary for the performance of the contract available on the spot at the Ordering Party.
4. The Contracting Authority does not provide for the requirements referred to in Article 95(1) of the PPL.
5. The Contracting Authority does not specify in the description of the subject matter of the contract the requirements related to the performance of the contract, which may include economic, environmental, social, innovation, employment or confidentiality aspects of the information provided to the contractor in the course of the performance of the contract, referred to in Article 96 of the PPL.
6. The Contracting Authority does not reserve the right to apply for the award of the contract only by contractors referred to in Article 94 of the PPL.
7. The contract in question takes into account the requirements in terms of accessibility for people with disabilities.
