1. The subject of the contract is a comprehensive supply of electricity including the sale of electricity and the provision of transmission and distribution services of electricity to the facilities of the municipality of Kołbaskowo for a period of 12 months in tariff groups: C11, C11a, C12a, C21, B21, in accordance with the provisions of the Act of 10 April 1997. 2. The supply of electricity and distribution services shall take place under the conditions laid down by:

a) the Energy Law Act (consolidated text: Journal of Laws of 2022, item 1385, as amended) and based on the implementing regulations to this Act,

b) Public Procurement Law (Journal of Laws of 2022, item 1710, as amended)

c) the Civil Code Act (consolidated text: Journal of Laws of 2022, item 1360)

Electricity should meet technical parameters in accordance with the provisions of the Energy Law and the Regulations implementing this Act and Polish Standards.

3. Detailed information on individual collection points in terms of concluded contracts, locations are presented in Annex 6 to the SWW.

4. The estimated amount of energy supplied (+/-20%) in the delivery period (12 months) was determined on the basis of energy consumption in 2022 and amounts to 676.41 MWh. The above-mentioned forecast electricity consumption is indicative and may differ from the amount of energy actually consumed during the term of the contract. Reducing or increasing the amount of electricity does not entail any consequences for consumers, apart from the need to pay for the amount of energy actually consumed and the transmission service. The contractor should take into account the fluctuation of consumption at the level of (+/-) 20%.

5. The current Distribution System Operator is ENEA Operator Spółka.

6. The amount of electricity purchased shall be settled according to the actual consumption of this energy by the contracting authority, in accordance with the invoices submitted by the contractor.

7. The subject of the contract includes a comprehensive service within the meaning of Article 3(30) of the Law of 10 April 1997. Energy law, implemented on the basis of a comprehensive service, consisting in the provision of transmission, distribution and sale of electricity.

8. The Contracting Authority informs that as part of this procedure, contracts for the comprehensive supply of electricity will be concluded separately with the managers of the following subordinate units of the contracting authority:

a) Complex of Educational Institutions in Kołbaskowo,

b) Primary School in Przecław,

c) Primary School in Będargowo,

d) Public Kindergarten in Przecław,

e) Commune Centre for Culture, Sport and Recreation in Przecław,

f) School and Kindergarten Complex in Przylepa.
