The subject of the contract are development, maintenance and technical assistance services for the waste management system, including financial settlements between the city and property owners (carried out in accordance with the Tax Ordinance) and monitoring the quality of performance of contracts concluded with Operators, provided for a period of 2 years from the date of conclusion of the contract (but not earlier than from 1.01.2024). A detailed description of the subject of the contract can be found in Annex 1 to the SWZ.

As part of the implementation of the subject of the contract, the Contractor will be obliged to ensure the continuity of the Application Software in order to timely implement the tasks of the City of Łódź Office resulting from the Act, in particular through:

a) Maintain the Application Software in compliance with the law and remove errors and defects in the Application Software and ensure the continuity of the Application Software,

b) Update the Documentation related to the Application Software,

c) Development of Application Software by introducing other modifications adapting the Application Software to the needs of the Ordering Party, including integration with the Ordering Party's systems,

d) Providing Technical Support services for Application Software/Solutions,

e) Update, supplement and deliver Source Codes, user documentation, training, administrator, as-built, technical and developing paths (in paper and electronic version) for the MGA System,

f) Conducting training of the Ordering Party's employees and Operators in the scope of the MGA System,

g) Transfer of proprietary copyrights to changes and modifications of the Application Software and Documentation and other works created during the implementation of the Agreement,

h) Transfer of Source Codes to the Application Software/System under the conditions specified in the Agreement,

i) Maintain and update the production, test/training environment in accordance with the conditions set out in the Agreement,

j) Renewal of existing or purchase of new SSL certificates for application servers on which the System operates, on the terms set out in the Agreement,

k) Perform additional work in the amount of 10,000 Man-hours on the terms set out in point 3.4 and in the Agreement.
