1. The subject of the contract is the supply of electricity in the period from 01.01.2023 to 31.12.2023 - up to 581 consumption points (PPE) with a total estimated volume (+/-10%) of 9 841.61 MWh, of which:
1) For premises and facilities tariff group C, G, R - Part 1 of the order – 6 182.70 MWh – a detailed list of PPE is attached as Annex 1a to the SWZ
2) For premises and facilities tariff group B - Part 2 of the contract - 2 607.91 MWh - a detailed list of PPE is attached as Annex 1b to the SWZ
3) For the purposes of road lighting - Part 3 of the contract - 1 051.00 MWh - a detailed list of PPE is attached as Annex 1c of the SWZ.
2. The forecast electricity consumption indicated above is indicative and may deviate from the amount of energy actually collected, during the duration of the contract. Reducing or increasing the amount of electricity does not entail any consequences for the contracting (customers), other than the need to pay for the amount of energy actually collected.
Supply of electricity to premises and facilities tariff group C, G, R1. Number of measuring systems accounting for consumed electricity 419 pcs.
2. A detailed description of the pre-emptive points (PPE) of the Contracting Party included in Annex No 1a to the SWZ.
3. Estimated electricity consumption during the term of the contract – 6 182.7 MWh, of which: Zone I 3 971.33 MWh, Zone II 2 041.49 MWh, Zone III 169.88 MWh. The above data are indicative. The contractor should take into account possible fluctuations in electricity consumption at the level of (+/- 10%).
4. Deliveries will take place from 01.01.2023 to 31.12.2023. Details of the delivery times for each collection point are described in Annex 1a to the SWZ column "Delivery period".
5. Current electricity supply contracts will expire or terminate with effect from the day preceding the planned delivery start date (column 'Delivery period'). The obligation to terminate the contracts lies with the contracting authorities (recipients).
6. Regional Municipal Waste Utilization Plant "Rypin" Sp. z o.o. has the status of manufacturer; installation power 80,00 kW, source - biogas. The estimated amount of energy produced and introduced into the grid is about 5 MWh per year. The contracting authority provides for the conclusion of a contract with the contractor for the resale and balancing of energy generated and introduced into the network, on the model of the contractor. The contracting authority has a concession for the production of energy, with the settlement of excise duty made by the contractor - the energy seller.
7. The subject of the contract shall be the supply of electricity with quality standards specified in accordance with applicable regulations.
8. Quality standards of electricity are described in the Ep and the Regulation of the Minister of Economy of 4 May 2007 on detailed conditions for the functioning of the power system (as amended) and the Regulation of the Minister of Energy of 6 March 2019 with amendments on detailed rules for the formation and calculation of tariffs and settlements
in electricity trading.

10. The Contractor, based on the Power of Attorney granted, will be obliged to submit contracts on behalf of himself and the ordering parties (recipients) to the competent DSO in accordance with applicable regulations and to represent the ordering parties (recipients) before the DSO - the process of changing the seller.
11. The contracting authority reserves the right to make use of Article 139(1) of the Public Procurement Law, i.e. the possibility of first examining and evaluating tenders, and then making a subjective qualification of the contractor whose offer was the highest rated, in terms of the lack of grounds for exclusion and meeting the conditions for participation in the procedure.
12. As a result of the outcome of the public procurement procedure, 16 contracts will be concluded.
13. The Contractor shall lodge 15 securities for the proper performance of the contract, separately for each contract concluded with the contracting authorities, with the exception of the contract concluded with the Independent Public Health Care Institution in Rypin
14. The Ordering Party requests the deposit in the amount - Part 1 of the order: PLN 300,000.00.
Supply of electricity to premises and facilities tariff group B1. Number of measuring systems accounting for consumed electricity 9 pcs.
2. A detailed description of the pre-emptive points (PPE) of the Contracting Party included in Annex No 1b to the SWZ.
3. Estimated electricity consumption during the term of the contract – 2 607.91 MWh, of which: Zone I 1 057.91 MWh, Zone II 281.82 MWh, Zone III 1 268.18 MWh. The above data are indicative. The contractor should take into account possible fluctuations in electricity consumption at the level of (+/- 10%).

9. The Contractor, based on the Power of Attorney granted, will be obliged to submit contracts on behalf of himself and the ordering parties (recipients) to the competent DSO in accordance with applicable regulations and to represent the ordering parties (recipients) before the DSO - the process of changing the seller.

The Contracting Authority reserves the possibility of taking advantage of Article 139 (1) of Pzp, i.e. the possibility of examining and evaluating tenders in the first place and then making the qualifications of the contractor whose offer has been highest assessed, in the absence of grounds for exclusion and fulfilment conditions of participation in the proceedings.
11. As a result of the outcome of the public procurement procedure, 3 contracts will be concluded.
12. The Contractor shall lodge 3 performance bonds separately for each contract concluded with the contracting authorities.
13. The Ordering Party requests the payment of a security deposit in the amount - Part 2 of the order: PLN 130,000.00.
Supply of electricity for the needs of road lighting1. Number of measuring systems accounting for consumed electricity 153 pcs.
2. A detailed description of the pre-emptive points (PPE) of the Contracting Party is included in Annex No 1c to the SWZ.
3. Estimated electricity consumption during the contract period 1 051.00 MWh, of which: Zone I 404.87 MWh, Zone II 646.13 MWh. The above data are indicative. The contractor should take into account possible fluctuations in electricity consumption.
4. Deliveries will take place from 01.01.2023 to 31.12.2023. Details of the delivery dates (start and end) for each collection point are described in Annex 1c to the SWZ column "Delivery period".
5. Current electricity supply contracts will expire or terminate with effect from the day preceding the planned delivery start date (column 'Delivery period'). The obligation to terminate the contracts lies with the contracting authorities (recipients).

12. The Contractor shall lodge 6 securities for the proper performance of the contract separately for each contract concluded with the contracting authorities, with the exception of the contract concluded with the Municipality of Brzuze.
13. The Ordering Party requests the payment of a security in the amount - Part 3 of the order: PLN 50,000.00.
