Delivery of diesel fuel to the garage petrol station in Czołowo. 2.2. The subject of the contract is the purchase of diesel fuel for buses with delivery to the garage petrol station in Czołowo, at 1 Kórnicka Street, in the total amount of 920000 liters of ON B7 (920 m3 ON).

2.3. The Ordering Authority has a ground tank with a capacity of 20 thousand. Liters. The Ordering Authority will accept deliveries from Monday to Friday from 7 to 15 o'clock.

2.4. The Ordering Party reserves the right to increase the basic volume of 920,000 l ON B7 by 25%, i.e. by 230000 l (230 m3 ON) under the option right, on the terms presented in the contractor's offer, taking into account the provisions of the contract (including amendments). The right of option should be understood as a right, not an obligation of the contracting authority. The exercise of the right of option may or may not take place, depending on the needs of the contracting authority and as a result of his disposition in this respect. In the event of increased needs of the Ordering Party for diesel oil, he may exercise his right of option with an appropriate declaration of will in this respect submitted to the Contractor. Preliminary schedule for the use of these options in 12 months (for the entire period of validity of the contract). The price discount under the option right does not change in relation to the price discount specified in the offer form.

2.5. The Contracting Authority shall pay the Contractor a remuneration for the deliveries made by transfer to the Contractor's bank account within 30 days (criteria for evaluation of tenders — min. 14 days), counting from the date of delivery to the Contractor of the correct invoice.

2.6. Settlements between the Contracting Authority and the Contractor will be held only

in Polish zloty (PLN), excluding foreign currencies.

2.8. The Contractor guarantees that the fuel sold will meet the quality requirements set out in the Regulation of the Minister of Economy of 9 October 2015 on quality requirements for liquid fuels (Journal of Laws of 2015, item 1680, as amended).

and the requirements specified in the standard replacing the PN-EN 590 standard with the PN-EN 590+A1:2017-06 standard, unless the above provisions change. Then the applicable standard applies.

2.9. The Contractor shall deliver fuel to the Ordering Party's ground tank

within the prescribed period, using means of transport which comply with the standards provided for in environmental legislation.

2.10. Place of fuel deliveries: garage petrol station located at the Ordering Party's base in Czołowo at 1 Kórnicka Street.

2.11. The Ordering Party does not trade in liquid fuels. The ordered fuel will be used only for own purposes.

2.12. The measurement of the amount of fuel received will take place on a legalized tank. The tank has the legally required characteristics and legalization deadlines and meets the requirements specified

in the Regulation of the Minister of Economy of 21 November 2005 on the technical conditions to be met by liquid fuel bases and stations, long-distance transmission pipelines used for the transport of crude oil and petroleum products and their location (i.e. Journal of Laws of 2014, item 1853, as amended)

2.13. The Ordering Party's measuring devices meet the provisions of the Regulation of the Minister of Economy of 22 January 2008 on the requirements to be met by measuring tanks and the detailed scope of tests and checks performed during the legal metrological control of these measuring instruments (i.e. Journal of Laws of 2021, item 373)

2.14. All costs and components related to the performance of the subject of the contract,

in particular costs related to delivery and transport, insurance,

including customs duties and taxes, labour costs, etc. should be included in the offer price. The detailed scope and method of delivery is specified in the provisions of the draft contract constituting an annex to the SWZ.

The Ordering Party intends to allocate a gross amount for the implementation of the order: PLN 6,326,840.00.
