According to section 61 of the Act on Public Procurement and Concession Contracts in Special Sectors, a contracting entity may shorten the time limit for an open procedure laid down in section 60(2) of the Act on Public Contracts in Specific Sectors if it is practically impossible to comply with the time limit in the procedure due to the urgency duly justified by the contracting entity. However, in the case of an open procedure, the time limit for tenders shall not be less than 15 days.
The schedule for the renovation of the Port of Naantali terminal is very critical. Passenger traffic through the terminal will start in summer 2023. Therefore, the premises used by the authorities, such as Customs, in particular, must also be ready and available by the time passenger traffic begins. The completion of demolition work in time before the start of other contract work is intrinsically linked to the schedule of the entire contract and the completion of the premises within the required schedule. A delay in the start of demolition work would lead to a material delay in the entire contract schedule. Demolition work must begin no later than December 05.12.2022. Thus, it is impossible to comply with the deadlines for the open procedure laid down in the Act on Public Procurement in Special Sectors. The contracting entity therefore has an appropriate basis for following the accelerated procedure.
