1. The subject of the contract is the supply of pharmaceutical products divided into 105 lots for the Władysław Biegański District Hospital in Iława 2. Obligations of the Contractor: • Delivery and transport • Unloading and bringing to storage rooms. 2.1. Pharmaceutical products must have a validity period of at least 12 months from the moment they are delivered to the Ordering Party's premises. It is allowed to deliver products with a shorter period only with the consent of the authorized representative of the Ordering Party. 2.2. In each of the packages, it is allowed to use equivalent drugs, i.e. a preparation with the same composition of active substances, dose and form of the drug (vial, ampoule, aerosol, dry substance. etc.) The preparation must have the same indications for use as the preparation specified in the subject specification. 2.3. If the offered package of the drug contains a different number of units (tablets, ampoules, etc.). The Contractor is obliged to recalculate the number of packaging. If, after conversion, an incomplete number of packages is obtained, the quantity offered must be rounded up. 2.4. In the absence of the offered preparation on the market, the Contractor is obliged to replace it with a synonymous drug at a price not higher than the tender price (after consultation with the Head of the Hospital Pharmacy Department). If the package of a synonymous drug contains a different number of units (e.g. tablets, ampoules, etc.), its price should be converted so that the price of 1 unit (tablets, ampoules, etc.) in the package is not higher than the price of 1 unit according to the tender contract. 2.5. If delivery of an equivalent preparation is not possible or it is impossible to deliver the missing drug within 48 hours, the Contractor is obliged to issue a written note (which will be the basis for the purchase of the drug in another pharmaceutical wholesaler) and to cover the difference in purchase costs. 2.6. Transport packages of medicines requiring cold storage (2-8 degrees C) should be marked and a disposable temperature indicator must be placed inside the package to confirm the correct transport conditions. 2.7. If, during the tender procedure, the drug required by the Ordering Party is not produced, the price form constituting Annex 1 to the Terms of Reference should include the last sale price and indicate the relevant information. 2.8. It is possible to convert the formulation from: -capsules to tablets, from tablets to film-coated tablets or capsules and vice versa - vials for ampoules or pre-filled syringes and vice versa
