The AOK Federal Association is the service-oriented lobbyist of the AOK community. The AOK community insures more than 26 million people nationwide in eleven different AOKs. The subject of this non-exclusive approval procedure (so-called "open house procedure") is a framework agreement for the provision of KIM mailboxes for the AOK community until any exclusive contracts come into force after a public tender. The framework agreement within the framework of this approval procedure will come into force for the first time on October 9, 2020 and will end on December 31, 2024. Irrespective of this, it ends automatically when any exclusive contract comes into force as a result of a formal award procedure.
The subject of the open house procedure is the following:
- Provision of "KIM mailboxes" for the client:
—— Registration and, if necessary, deregistration of the client as a KIM participant;
—— Update of the (KIM) mail addresses in the client's directory entry in the TI directory service (VZD);
—— Provision of an interface on the contractor's KIM mail server for sending and collecting e-mails by the principal's basic consumer;
—— Transmission and intermediate storage of the KIM e-mails from and to the client by the contractor's mail server.
- KIM mailboxes for test and production systems of the client;
- Service and support for the client and his IT service providers;
- Support of the client and his service providers with testing, acceptance and commissioning.
Note: Publication is done here using the open procedure form. However, this is not such an open procedure - the notification form had to be used for technical reasons, as there is no suitable form for the approval procedure. The clients assume that this approval procedure does not fall within the scope of the “antitrust law” due to the lack of a selection decision and therefore the non-discriminatory access to the framework agreement for all interested companies.
In order to do justice to the diversity of potential contractual partners within the framework of the approval model, every suitable company will be able to join the framework agreement under the same conditions until October 31, 2020. The contract documents required for this are available for download under the link mentioned in I.3). The prerequisites for admission or later joining the framework agreement that will come into force on October 9, 2020 is the complete and timely submission of the following evidence / declarations / attachments:
1. Application for approval or to join the framework contract "Provision of KIM mailboxes" (form),
2. Proof of entry in the professional or commercial register (not older than 6 months at the time of the application for admission or accession) in accordance with the legal provisions of the country in which the company is based (in a non-certified copy) or, if applicable, declaration that, in accordance with the respective state legislation, there is no entry in the professional or commercial register (form),
3. The company's signed self-declaration on reliability (form),
4. signed self-declaration that the company has fulfilled its obligations to pay taxes, duties or social security contributions (form),
5. Evidence that the interested party is approved by gematik as a "provider of operational services for the secure KOM-LE transmission process". If the interested party has not yet been admitted, a schedule for achieving admission with the achievement of the milestones specified in the service description, stating the respective dates, is required and must be submitted by the interested party.
6. Signed framework contract with a company stamp "Provision of KIM mailboxes" (3 copies in the original) without attachments.
The above-mentioned documents are to be sent by post marked with "Open-House Procedure Provision of KIM Postboxes" to:

In order to join the framework agreement on October 9, 2020, the previously named documents must be received by the AOK Bundesverband at least 7 days in advance, i.e. no later than October 2, 2020 at 12 noon.
