The subject of the contract is the supply (sale) of electricity for street lighting and traffic lights in the city and municipality of Wieliczka in 2023. The supply (sale) of electricity includes active electricity: round-the-clock, night and day.

2.The Ordering Party plans to purchase a total of about 4 705 000 kWh in 2023, of which in the tariff:

a) daily active energy C12b - 2 016 000 kWh,

b) active night energy C12b - 2 619 000 kWh,

c) 24/7 energy C11 - 70,000 kWh,

1. The subject of the contract is the supply (sale) of electricity for street lighting and traffic lights in the city and municipality of Wieliczka in 2023.

2. The supply (sale) of electricity shall include active electricity: round-the-clock, night and day. Technical parameters:

2.1. Tariff group C11 and C12b

2.2. The Ordering Party plans to purchase a total of approximately 4,705,000 kWh in 2023, of which in the tariff:

2.2.1.1) active daily energy C12b - 2 016 000 kWh,

2.2.1.2) active night energy C12b - 2 619 000 kWh,

2.2.1.3) round-the-clock energy C11 - 70 000 kWh,

2.3. Number of collection points 288 pcs. Collection points are located in the area of OSD-TAURON Dystrybucja Spółka Akcyjna 31-538 Kraków, Jasnogórska 11 Street. Road lighting is controlled using dusk sensors and astronomical clocks.

3. The Contractor who wins the tender undertakes to submit on behalf of the Ordering Party to the Distribution System Operator competent for the Ordering Party, a notification on the conclusion of a contract for the sale of electricity. The distribution agreements currently in force are concluded for a definite period of time, i.e. until 31.12.2022. The Ordering Party shall grant an appropriate power of attorney to the Contractor in order to conclude contracts for the provision of distribution services in a term enabling the effective conduct of the procedure for changing the seller.

4. The Ordering Party informs that separate contracts for the sale and distribution of electricity are currently in force. They are concluded for a period of one year, and their validity expires on 31.12.2022. The current seller of electricity is: PGE Obrót S.A. 35-959 Rzeszów, 8-go Marca 6 Street, the contract is valid until 31.12.2022.

5. Note. The Contracting Authority belongs to the group of eligible customers referred to in Article 2(2)(d) of the Act of 27 October 2022 on extraordinary measures aimed at limiting electricity prices and supporting certain customers in 2023 (Journal of Laws of 2022, item 2243). Therefore, the provisions of the above-mentioned Act apply to this order, including the offered price for the supply of electricity may not exceed the maximum price specified in Article 2(1)(b) of the aforementioned Act, i.e. the price of PLN 785 / MWh (PLN 0.785 / kWh). The Contracting Authority shall submit to the Contractor an appropriate statement referred to in Article 5 of the Act of 27 October 2022 on emergency measures aimed at limiting electricity prices and supporting certain customers in 2023.

6. The supply of electricity will take place under the conditions set out in the Act of 10 April 1997 - Energy Law (i.e. Journal of Laws of 2022, item 1385, as amended), implementing regulations to this Act, and in particular the Regulation of the Minister of Economy of 4 May 2007 on the detailed conditions for the functioning of the power system (i.e. Journal of Laws of 2007 No. 93, item 623, as amended), Tariff for electricity distribution services of the relevant Distribution System Operator (DSO Tariff), Distribution Network Operation and Operation Instructions (IriESD) and generally applicable legal regulations. The Contractor is obliged to sell electricity in compliance with applicable quality standards, i.e. to provide the Ordering Party with quality standards of service in accordance with the applicable provisions of the Energy Law.
