The subject of the contract is the supply of electricity and the provision of electricity distribution services for the Warta Commune, subordinate facilities and infrastructure as well as municipal units in the period from 01.01.2024 to 31.12.2024.

4.2. The sale of electricity is to take place under the conditions specified in the provisions of the Act of 10.04.1997. Energy Law, in accordance with the applicable regulations to the above-mentioned Act, in particular the Regulation of the Minister of Economy of 04.05.2007. on specific conditions for the operation of the power system, tariff for electricity distribution services of the relevant Distribution System Operator (DSO Tariff), Distribution Network Operation and Operation Instructions (IRiESD) and generally applicable legal provisions

4.3. The Contractor is obliged to have a comprehensive agreement with the Distribution System Operator to whose network the Contracting Authority's facilities are connected, enabling the provision of comprehensive services for the facilities covered by this contract.

4.4. The list and characteristics of the facilities in the Warta Municipality are included in Appendix No. 9 to the Terms of Reference.

4.5. The list of photovoltaic installations is included in Appendix 10 to the Terms of Reference.

4.6. The estimated electricity consumption for individual tariff groups in the Contracting Authority's facilities in the period from 01.01.2024 to 31.12.2024 is 980,988 kWh Appendix No. 9 to the Terms of Reference.

4.7. It is envisaged that the collection points may be increased. An increase in the collection points or a change of the tariff group is possible only within the tariff groups that have been included in the Terms of Reference and priced in the Contractor's Offer Form.

4.8. 15 photovoltaic installations have been installed in the commune's units, in which energy is billed in the prosumer system. 1 installation in which energy from photovoltaics will be settled in the Net-billing system.

4.9. The offered unit price for electricity is also to take into account the energy consumed by units with photovoltaic installations additionally taken from the power grid, which is not produced in the installation.

4.10. The Contracting Authority requires that the settlement of receivables for the consumed energy be made separately for each of the Customers, in settlement periods applied by the Distribution System Operator (hereinafter referred to as DSOs), according to the actual consumption with the payment date of invoices for the supplied electricity and distribution service specified for 21 days from the date of issue of the document.
