The subject matter of the proceedings is the selection of a beneficiary for the construction and operation of a high-speed Internet access (NGA) broadband infrastructure to be set up in the Amrum municipality of Nebel (OT Süddorf) of Föhr-Amrum and its operation as part of a network profitability gap funding. The procedure was initially supported by the contract notice EU 2018 / S 044-096178 of 03/03/2018 initially concerned the above subject as lot 2, while lot 1 concerned underserved areas on the island of Föhr. For lot 1, a contract has already been awarded in the meantime and a grant contract has been concluded. For lot 2, this notice implies a return of the procedure (while maintaining its identity) to the start of the competition by means of a new publication in order to take into account changes to the specifications of the award (in particular maximum funding, deadline).
The selected network operator has to set up the broadband infrastructure in its own name and at its own expense in the underserved areas ("white NGA spots") and operate it for the seven-year term of use, while ensuring comprehensive NGA broadband connection with corresponding end-customer products. The deployed broadband infrastructure in the upgraded areas must allow for symmetrical bandwidths up to 1 Gbit / s Downstream / Upstream on demand and on request for residential and commercial customers at each local loop. Not every end customer product offered must be designed in this way. However, consumer products must reliably guarantee at least 50 Mbps downstream (not just "up to"). The Office does not intend to procure benefits that are itself economically beneficial to it. The network operator to be selected in the present proceedings receives no remuneration from the Office. The award is for the selection of a beneficiary, it does not concern a public contract. The successful bidder concludes a public-service grant agreement for investment aid to close the profitability gap, on the basis of the framework of the Federal Republic of Germany to support the development of a nationwide Next Generation Access (NGA) broadband network (v. 15.6.2015) and the Broadband Directive in rural areas of Schleswig-Holstein - Broadband Directive - of 30.5.2017. The Office has received a grant letter (amended several times) from the Land under this directive, the terms of which become part of the grant agreement (including the amount of municipal subsidies).
