Description:
Successive supply of liquid fuels for: 1) Municipal Department of Communication Sp. z o.o. with registered office in Słupsk, Enterprise Komunalna Sp. z o.o. in Słupsk, “Wodostrów Słupsk” Company z o.o.

1. The subject of the contract is the successive supply of liquid fuels along with transport in the total estimated quantity:

1) 21,782,000 litres (21,782 m3) of diesel;

2) 2,800,000 liters (2,800m3) of unleaded petrol Pb 95.

2. Under the subject of the contract, the Contracting Authority provides for the following estimated fuel quantities:

1) for the Municipal Department of Communication Sp. z o.o. with its registered office in Słupsk:

(a) 20,000,000 litres (20,000 m3) of diesel fuel,

(b) 2,800,000 litres (2,800 m3) of unleaded petrol Pb 95;

2) for Enterprise Komunalna Economy Sp. z o.o. in Słupsk:

(a) 1,350,000 litres (1,350 m3) of diesel;

3) for “Slupsk Waterworks” Sp. z o.o. in Słupsk:

a) 432,000 litres (432 m3) of diesel fuel.

Chapter IV — Description of the item of the order

1. The subject of the contract is the successive supply of liquid fuels together with transport in the quantities indicated in point II.1.4, i.e. 'Short description'.

2. Requirements of the Ordering Party for the object of the order:

1) Fuel must meet the quality requirements of the currently applicable Polish Standards:

(a) PN-EN 590+A1:2017-06/Ap1 — for diesel;

(b) PN-EN 228+A 1:2017 -06/Ap1 — for unleaded petrol Pb95;

or equivalent to the abovementioned standards;

2) fuels, i.e. both diesel and unleaded petrol Pb95 must meet the quality requirements laid down in the Regulation of the Minister of Economy of 9 October 2015 on quality requirements for liquid fuels (OJ 2015, item 1680, as amended);

3. During the course of the contract, the Contractor shall be obliged to attach the current quality certificate of the fuel manufacturer made by the accredited laboratory concerning the batch delivered. Atest must:

(a) contain data characterizing the supplied fuels,

(b) be provided on the date of execution of the test,

(c) be made no earlier than 7 days before delivery;

4) The Contracting Authority requires that the diesel supplied by the Contractor is suitable for the season and the prevailing temperature conditions;

(5) the technical and chemical parameters must not be inferior to those specified in/in the standards and in the Annexes to the Regulation;

6. The Contracting Authority requires that fuel be transported in accordance with the requirements of the specific provisions on the transport of hazardous materials, as set out in the ADR Agreement;

7. “In accordance with applicable law, in the event of a discrepancy between the standard and the regulation, the provisions of the Regulation shall apply”;

8) The Contracting Authority requires that the fuel supplied by the Contractor be located in the sealed chambers of the autocystern. If fuel is delivered to at least two entities in the same supply, the Contractor is obliged to place the fuel in separate autocystern chambers for each of those entities;

9) The Contracting Authority provides for three fuel deliveries per week. As part of delivery, up to three delivery places for the indicated Orders may appear;

10) The Contracting Authority will require that the Contractor whose offer has been selected, before signing the contract, submit to the Contracting Authority a copy of the commercial agreement with the fuel manufacturer, from which the availability of fuels will arise for the purposes of the implementation of this tender. Fuel producers will be exempt from the requirement;

11) The Contracting Authority informs that the fuel stations and storage tanks to which the Contractor will deliver fuel supply meet all the requirements laid down in the Regulation of the Minister of Economy of 21 November 2005 on the technical conditions to which the fuel bases and stations should correspond to liquid, far-reaching transmission pipelines for the transport of petroleum and petroleum products and their location (Journal of Laws of 2014, item 1853, as amended);

12) The Contractor shall include deliveries to the Contracting Authority with a company qualitative surveillance system enabling the identification of possible irregularities in the storage, loading and transport process of fuel. A statement for this circumstance is included in the offer form;

13. A detailed description of the implementation of the fuel supply subject to this proceeding is set out in the Annexes:

(a) No 3 to SWZ — a model contract for the Municipal Department of Communication Sp. z o.o. with its registered office in Słupsk;

(b) No 4 to SWZ — a model contract for Enterprise Komunalna Sp. z o.o. in Słupsk;

(c) No 5 to SWZ — model contract for “Slupsk Waterworks” Company z o.o.
