The subject of the order is the successive purchase of hot-asphalt mixtures and asphalt high-speed cation emulsion for the needs of the Enterprise Services Municipal Sp. z o.o. in Tarnów in 2022.
SUCCESSIVE PURCHASE OF HOT-ASPHALT MINERAL-ASPHALT MIXTURES1. The subject of this part of the order is the successive purchase by the Ordering Party of mineral and asphalt hot mixtures with the following assortment and quantity:
1) Mineral mix — asphalt abrasive layer AC5 S, AC8S and AC11S for roads KR1-4 assortment quantity- 5000 Mg
2) Mineral mix — asphalt abrasive layer for roads KR5-6 quantity of assortment - quantity of offering- 200Mg
3) Mineral mix — asphalt binding layer AC16W, AC22W for roads KR1-4 -quantity of assortment - offer quantity - 3000Mg
4) Mineral mix — asphalt binding layer for roads KR 5-6 quantity of assortment
number of offers - 200 Mg
2.Requirements that must meet the offered hot-hot mineral and asphalt mixtures:
1) hot mineral and asphalt mixtures (hereinafter “materials”) must be free of defects, placed on the market and use in the performance of roadworks to the extent corresponding to its useful characteristics and purpose, in accordance with applicable law, including the Act of 07.07.1994. Construction Law (Journal of Laws 2020 item 1333), Law of 16.04.2004 on construction products (Journal of Laws of 2021, item 1213) and other relevant provisions, including Regulation of the Minister of the Environment of 27.10.2005 on the types and conditions of application of measures which may be used on roads public, streets and squares (OJ 2005, item 1960), meet the technical and operational parameters and requirements specified in the SWZ, comply with the technical conditions of WT-2 2010 “Asphalt mineral-blends”, meet the quality requirements defined by PN-EN 13108- 1:2016 -07 or equivalent, and have appropriate certificates, certificates or technical approvals. The certificates and certificates in force in the EU presented, for example, in English will be honoured if translated into Polish.
2) Under the concept of above-equivalence, the Contracting Authority understands that the materials offered meet the requirements of the said standard in terms of: aggregate grain, binder properties, binder type, homogeneity.
3. Materials should have a document confirming the authorisation for use in construction, which must be delivered on the date of signing the contract, prior to the commencement of deliveries.
4) The Contractor shall, on the date of signing the contract, before the start of delivery, provide the Ordering Party with
(a) “Hazardous preparation safety sheet” for the material supplied,
(b) laboratory prescription in accordance with WT-2 2010 “Asphalt Mineral Mixtures” will be produced.
5) The Contracting Authority shall have the right to request from the Contractor current certificates, declarations of conformity or laboratory tests of hot mineral and asphalt mixtures. The Contractor is obliged to have up-to-date certificates of the body entitled to quality control proving that the mineral and asphalt mixtures supplied conform to certain technical standards or specifications.
3.Requirements for the execution of the order:
1) The Contractor is obliged to dispose for the purpose of the order of a bituminous mass manufacturer located at a distance (for technological reasons) of not more than 5 km from the administrative boundaries of the city of Tarnów, counting on paved roads, using the data contained on website https://www.google.com/maps.
The Contractor in the tender form annex 1 to the SWZ shall indicate the bituminous mastic plant intended for the execution of the order with the indication of its location (address) and distance in km from the administrative boundaries of the city of Tarnów counting on the paved roads calculated using data contained on the website https://www.google.com/maps. The Contracting Authority shall verify the distance provided by the Contractor in this regard in the tender form forming Annex 1 to SWZ also using the data contained on the website https://www.google.com/maps.

SUCCESSIVE PURCHASE OF ASPHALT CATIONIC HIGH-GROWTH EMULSION1.The subject of this part of the order is the successive purchase by the Ordering Party of asphalt quick-fall cation emulsion with the following assortment and quantity:
Asphalt emulsion C65 B3 PU/RC - assortment quantity - offer quantity - 200 Mg
2. Requirements to be met by the offered asphalt quick-fall cation emulsion:
1) asphalt high-growth cation emulsion (hereinafter “materials”) must be defect free, placed on the market and use in the performance of roadworks to the extent corresponding to its useful characteristics and purpose, in accordance with applicable law, including the Act of 07.07.1994. Construction Law (Journal of Laws 2020 item 1333), Law of 16.04.2004 on construction products (Journal of Laws of 2021, item 1213) and other relevant provisions, including Regulation of the Minister of the Environment of 27.10.2005 on the types and conditions of application of measures which may be used on roads public, streets and squares (OJ 2005 item 1960), meet the technical and operational parameters and requirements specified in the SWZ, meet the quality requirements defined by PN-EN 13808:2013 -10 or equivalent, and have relevant certificates, certificates or technical approvals, including National Declaration of Compliance. The certificates and certificates in force in the EU presented, for example, in English will be honoured if translated into Polish.
2) Under the concept of abovementioned equivalence, the Contracting Authority understands that the materials offered meet the requirements of the said standard in terms of: organoleptic properties, particle polarities, decay index, penetration capacity, asphalt content, Adhesion.
3. Materials should have a document confirming the authorisation for use in construction, which must be delivered on the date of signing the contract, prior to the commencement of deliveries.
4) The Contractor shall, on the date of signing the contract, before the commencement of delivery, provide the Contracting Authority with a “Hazardous Preparation Charter” for the material supplied,
5) The Contracting Authority shall have the right to request from the Contractor current certificates, declarations of conformity or laboratory tests of asphalt-cationally rapid development emulsion. The Contractor shall be obliged to have up-to-date certificates of the body entitled to quality control proving that the supplied asphalt cation emulsion conforms to certain technical standards or specifications.
3.Requirements for the execution of the order:
1) The Contractor is obliged to dispose for the purpose of the order of an asphalt emulsion plant (or an adequate number of emulsion storage tanks) at a distance (for technological reasons) of not more than 5 km from the administrative boundaries of the city of Tarnów counting on paved roads, using the data contained on the website https://www.google.com/maps.
The Contractor in the Tender Form of Annex 1 to SWZ shall indicate the asphalt emulsion plant (or the adequate number of emulsion storage tanks) provided for the execution of the order with their place of location (address) and distance within km from the administrative boundaries of the city Tarnów by counting on paved roads calculated using the data contained on the website https://www.google.com/maps. The Contracting Authority shall verify the distance provided by the Contractor in this regard in the Tender Form of Annex 1 to SWZ also using the data contained on the website https://www.google.com/maps.
2) For asphalt cation emulsion, the Contractor will grant the Ordering Party min. 24- month quality guarantee. The term of this guarantee shall be counted separately for each batch of emulsion from the date of acceptance by the Ordering Party.
3. Other detailed conditions for the execution of the contract are defined by the contractual provisions designed - Annex No 7b to the SWZ.
