1. The subject of the contract is the service consisting in the maintenance and servicing of automation systems in the tunnel of the Krakow Fast Tram.

2. The Contracting Authority has described the Subject of the Contract by means of the following attachments:

a) the proposed provisions of the agreement constituting Annex 2 to the SWZ,

b) Material scope constituting Appendix No. 8 to the Terms of Reference.

c) Technical Documentation constituting Appendix No. 9 to the Terms of Reference.

3. Term of service: 24 months from the date of conclusion of the contract.

3. Pursuant to Article 95(1) of the Public Procurement Law, the Contracting Authority requires the Contractor or Subcontractor to employ persons performing the following activities on the basis of an employment relationship, with the exception of persons performing the so-called independent technical functions in the construction industry within the meaning of the Construction Law:

(a) Junior technical staff (organisation and delivery of services)

(b) Blue-collar workers (direct provision of services)

The contracting authority allows the possibility of personal performance of the contract by persons conducting business activity or partners of a commercial law company.

4. The Contracting Authority does not require the submission of an offer after the on-site inspection and verification by the Contractor of the documents necessary for the execution of the contract available on site at the Contracting Authority.
