1. The subject of the contract is the supply of electricity together with distribution for the purposes of functioning of municipal facilities in the Liniewo Municipality.
2. The total amount of electricity supplied during the contract execution period to all electricity consumption points described in Switch No. 6 to the SWZ is forecast at the level of 831.01 MWh.
3. Any change in the estimated consumption (fluctuation at the level of +/- 30%) will not result in additional costs for the Ordering Party, apart from settlement for the amount of energy actually consumed at the prices specified in the offer, with the Ordering Party 70% of the volume indicated in paragraph 2.
4. The detailed scope and list of energy consumption points are set out in Annex 6 to the SWZ.

5. The supply of electricity is to take place under the conditions specified in the provisions of the Energy Law and the Civil Code and in accordance with the implementing provisions issued on their basis.
6. The forecasted electricity consumption indicated in Annex 6 to the SWZ is indicative and may differ from the amount of energy actually consumed during the term of the contract. Reducing or increasing the amount of electricity does not entail any consequences for the contracting authority, except for the need to pay for the amount of energy actually consumed.
7. The Ordering Party reserves that each change in the law enabling, in particular, the "freezing" of electricity price rates, will result in compliance with these legal provisions.
8. The Ordering Party shall not allow the submission of partial tenders. Pursuant to Article 91(1) of the PPL Act, the division of a contract into lots is a right of the Ordering Party, not an obligation. In addition, the division of that contract is not expedient and would cause significant difficulties in the performance of the contract.
