Preparation of design documentation related to the implementation of the task entitled "Reconstruction and extension of the railway siding of "PKP Intercity" S.A. Lublin" together with the author's supervision

1. The subject of the contract is the preparation of design documentation related to the implementation of the task entitled "Reconstruction and extension of the railway siding of "PKP Intercity" S.A. Lublin" together with the author's supervision.

2. The procurement procedure shall be conducted in the form of an open tender, on the basis of Act of 11.9.2019 Public Procurement Law, hereinafter referred to as the "PPL Act" or "PPL"

3. Pursuant to Article 139(1) of the PPL Act, the contracting authority provides for a reverse order of evaluation of tenders, i.e. it will first examine and evaluate tenders to determine the highest rated tender, and then make a subjective qualification of the Contractor whose offer has been rated the highest in terms of the lack of grounds for exclusion and meeting the conditions for participation in the procedure.

1. The subject of the contract is the preparation of design documentation related to the implementation of the task entitled "Reconstruction and extension of the railway siding of "PKP Intercity" S.A. Lublin" together with the author's supervision.

2. The subject matter of the contract referred to in paragraph 1 has been divided into stages, which consist of:

1) Stage I - refers to the implementation of:

a) Inventory of the existing condition of the siding and facilities to the extent necessary to prepare the design documentation.

b) Preparation of an up-to-date map for design purposes, in accordance with applicable regulations, along with additional geodetic measurements in order to obtain data, allowing for comprehensive development of design documentation.

c) Execution of geotechnical surveys and geotechnical documentation.

d) On behalf of the Contracting Authority, the Contractor obtains all necessary opinions from the authorities, submits applications, prepares maps with a division project and lists of changes to the cadastral data, and effectively obtains a decision on the location of a public purpose investment for the scope of the investment/decision on development conditions – if it is necessary to obtain such documents.

e) The Contractor, on behalf of the Contracting Authority, obtains the position of the environmental protection authority in the form of an environmental decision or a position on the lack of necessity to obtain a decision in the form of a decision on refusal to initiate proceedings, if the issuance of the decision in the opinion of the environmental protection authority is not justified. In addition, the contractor will obtain a declaration from the authority responsible for monitoring NATURA 2000 sites and a declaration from the authority responsible for water management.

f) Execution of multi-discipline construction projects, taking into account the staging of future construction works. Separate documentation for each group of tracks, i.e.

- track group A 12, 14, 16, 18

-track group A1 18a, 20, 22a, 22b, 76

-track group B 80, 84, 86, 88, 90, 92, 94 and 96

- rolling stock repair hall with office and social facilities and track layout, including connection with track no. 20b according to the Concept.

g) Obtaining the relevant decisions on the demolition permit and the building permit together with the

with obtaining only final (valid) building permits or documents confirming the notification of the intention to carry out works.

h) Execution of detailed designs, taking into account the division into individual industries.

i) Preparation of tender materials for construction works together with Technical Specifications for the Execution and Acceptance of Construction Works, bills of quantities and investment cost estimates.

j) Preparation of answers/explanations to questions to OPZ asked at the stage of the tender procedure for the selection of the contractor for construction works.

2) Stage II – refers to the performance of author's supervision during the implementation of the investment task

3. A detailed description of the subject matter of the contract is included in Appendix No. 2 to the Terms of Reference.

4. The terms and conditions of the performance of the subject matter of the contract were specified by the Contracting Authority in the Draft Provisions of the Contract constituting Appendix No. 7 to the Terms of Reference.
