The subject of this contract is the EXECUTION OF A COMPREHENSIVE SUPPLY OF HIGH-METHANE NATURAL GAS TYPE E FOR THE NEEDS OF THE PURCHASING GROUP OF THE MUNICIPALITY OF ZAMOŚĆ for the facilities indicated in Annex 1 to SWZ. Gas supply will take place on the basis of an agreement containing the provisions of the sales contract and the contract for the provision of gas transmission or distribution services (comprehensive agreement) and will be performed in accordance with the provisions of the Energy Law, the Civil Code and implementing regulations issued on their basis. 3. Order – comprehensive supply of natural gas to the facilities listed in Annex 1 to the SWZ: The estimated demand for natural gas in the period from 01.10.2022 to 31.12.2023 is 12 068 586.00 kWh. The costs of using the subject of the contract in the above-mentioned period consist of: a fee for the sale of gas, a subscription fee, a fixed distribution fee and a variable distribution fee.
The subject of this order is the execution of a COMPREHENSIVE SUPPLY OF HIGH ETHANE NATURAL GAS TYPE E FOR THE PURPOSE OF THE PURCHASING GROUP OF THE MUNICIPALITY OF ZAMOŚĆ for the objects indicated in the area no. 1 to SWZ. The supply of gas will take place on the basis of a contract containing the provisions of the contract of sale and the contract for the provision of gas transmission or distribution services (comprehensive agreement) and shall be performed in accordance with the provisions of the Energy Law Act, the Civil Code and the implementing regulations issued on the basis of them.
Commune Zamość and units listed in Annex No 1 to SWZ will conclude separate contracts arising from this procedure for the award of a public contract in the mode of unlimited tender for the implementation of a COMPREHENSIVE SUPPLY OF HIGH ETHANE NATURAL GAS TYPE E FOR THE PURPOSE OF THE PURCHASING GROUP COMMUNE ZAMOŚĆ. Detailed information concerning the conclusion of contracts by the Municipality and its organizational units are included in the Annex No 1 to SWZ.
The Contracting Authority shall act on his own behalf and on the basis of a signed agreement (agreement for inspection at the premises of the Contracting Authority), on behalf of:

• Communes of Komarów Settlement
• Municipalities of Krasnobród
• Municipalities of Krasnystaw
• Municipalities of Lubenia
• Municipalities of Łabunie
• Municipalities Stary Zamość
As well as their organizational units, which are indicated in Annex 1 to the SWZ.
Order — Comprehensive supply of natural gas to the facilities listed in Annex 1 to SWZ:
The estimated demand for natural gas in the period from 01.10.2022 to 31.12.2023 is 12 068 586.00 kWh.
The cost of using the item of the order during the period consists of: gas sales fee, subscription fee, fixed distribution fee and variable distribution fee.
The estimated value of the contract in the period from 01.10.2022 to 31.12.2023 is PLN 3,734,752.88. The costs incurred during the entire period of using the subject of the contract do not include possible fees for exceeding the Contractual Capacity, fees for non-compliance by the Ordering Party with the restrictions introduced by the Distribution System Operator, and other additional fees set out in the Distribution System Operator Tariff, Instructions for Operation and Operation of the Distribution Network, which applies to both all Contractors and Ordering Parties (sellers and recipients), on the terms resulting from the tariff of the Distribution System Operator, instructions for operation and operation of the Distribution Network.
The Ordering Party informs that the process of changing the seller takes place at most collection points for the first time. Detailed information is contained in Annex 1 to SWZ.
In the Detailed Description of the Subject of the Order (Annex No. 1 to the SWZ), the Ordering Party indicated in the case of which gas collection points and in what part individual customers will benefit from tariff protection in accordance with the Act on special solutions for the protection of gas fuel customers in connection with the situation on the gas market (Journal of Laws of 2022, item 202).
