The subject of the contract is the supply of elements for the construction of Quantum Key Distribution (QKD) transmission systems with urban and intercity coverage and encryption devices for the construction of the PIONIER-Q network infrastructure, in accordance with the requirements of the contracting authority specified in the Detailed requirements regarding the subject of the contract (Part IV SWZ). The order is divided into the following parts:

Part 1 – delivery of elements for the construction of Quantum Key Distribution (QKD) transmission systems of urban and intercity range for the construction of the PIONIER-Q network infrastructure along with instructions on the configuration of the delivered elements (the instruction will be common to all receiving entities),

Part 2 – delivery of a set of encryptors for the PIONIER-Q infrastructure along with instructions on the configuration of the delivered encryptors (the instruction will be common to all receiving entities).

1. The subject of the contract is the supply of elements for the construction of Quantum Key Distribution (QKD) transmission systems of urban and intercity range and encryption devices for the construction of the PIONIER-Q network infrastructure, Part 1 – delivery of elements for the construction of urban and intercity Quantum Key Distribution (QKD) transmission systems for the construction of the PIONIER-Q network infrastructure along with instructions on the configuration of the delivered elements (the instruction will be common to all receiving entities).

2.Detailed requirements regarding the subject of the contract, including instructions, constitute an integral part of the description of the subject of the contract and are included in Part IV SWZ - respectively for each of the above-mentioned parts of the contract.

3.The specification of the devices for each of the receiving entities in the scope of each of the tasks of the contract is indicated in Part IV of the SWZ, where, in accordance with Article 99(6) of the PPL, the contracting authority indicated the criteria used to assess equivalence.

4.Locations (places of delivery) of the complete subject of the contract covered by a given part of the contract along with their assignment to individual receiving entities are indicated in Part IV of the SWZ.

5.The Contractor is obliged to provide each of the receiving entities with a quality guarantee and is obliged to perform the services resulting therefrom, as well as to carry out instructions on the configuration of the delivered elements for the construction of the system (for lot 1 of the contract) and configuration of the delivered encryptors (for lot 2 of the contract). The requirements for warranty and instruction are set out in Parts III and IV of the SWZ.

6.The delivered subject of the order must be brand new, not exhibited at exhibitions, complete and technically efficient. The statement "brand new" should be understood as the subject of the order originally packed, not used before the date of delivery, excluding the use necessary to test its correct operation after production.

7. The subject of the order must be free from any physical and legal defects and claims of third parties.

8.The delivered subject of the order must come from the distribution channel of the manufacturer not excluding distribution to the Polish market and ensuring the exercise of warranty rights.

9.The subject of the order must be delivered to individual receiving entities together with user manuals, controllers and any accompanying software necessary for the proper use of the subject of the contract (obtaining full functionality indicated in Part IV of the SWZ). Individual receiving entities will not be obliged to pay any additional fees, in particular license fees, and any licenses will be granted as part of the contractor's remuneration, without time and territorial limitation, unless otherwise expressly stated in Part IV of the SWZ. If licenses, codes or other permissions are needed to run and use this software, they must be provided at no additional charge. Codes, licenses, and other permissions must also be provided if they are necessary to run or configure hardware components. It is not necessary to provide user manuals, controllers and possible accompanying software if it is possible to download them from the respective services; In this case, however, the contractor is obliged to provide passwords, codes, etc. necessary to download.

10. The delivered item of the order intended for power supply from the power grid must be equipped with a sufficient number of power cables to allow it to be connected to standard power outlets, unless otherwise stated in Part IV of the SWZ.

11. The subject matter of the contract offered on the date of the tender may not be foreseen by the manufacturer to be withdrawn from production or sale.
