1. 1. The subject of the contract is the Supply of natural crushed stone aggregate as part of the investment entitled Reconstruction of the Skępe-Huta municipal road in the amount of 6,700 tonnes, which are covered by the basic contract and up to 1,925 tonnes constituting the right of option. 2. A detailed description and method of execution of the order is included in the Description of the Subject of the Order (OPZ), constituting Annex 3 to the SWZ.
1. The subject of the contract is the Delivery of natural crushed stone aggregate as part of the investment entitled Reconstruction of the Skępe-Huta municipal road in the amount of 6,700 tonnes, which are covered by the basic order and up to 1,925 tonnes constituting the right of option.
2. The term of the contract is 15.12.2023 for the basic order and for the contract covered by the option, if the Ordering Party exercises the option right.
3. The right of option:
1) The Ordering Party reserves the right of option to increase the scope of the contract for the supply of aggregate in the amount of up to 1,925 tonnes;
2) The contracting authority may not exercise the option right or exercise in part;
3) The order executed under the option is a unilateral right of the Ordering Party. Failure by the Ordering Party to exercise the right of option shall not give rise to any claims on the part of the Contractor against the Ordering Party;
4) the contract covered by the option will be performed by the Contractor after receiving a notification from the Contracting Authority that it intends to exercise the option right;
5) the deadline for the performance of the contract covered by the option set by the Contracting Authority may not be longer than the deadline for the performance of the basic contract;
6) The Contracting Authority shall notify the Contractor about the exercise of the option right by providing an appropriate notification;
7) the rules governing the performance of the contract covered by the option right shall be the same as those applicable to the performance of the basic contract;
8) The Ordering Party stipulates that the unit prices covered by the option will be identical as in the basic order;
9) The Ordering Party reserves that the order under the right of option is the maximum amount, and these quantities may change (decrease);
10) The Ordering Party is entitled to exercise the option right within a period of up to 30 days from the date of conclusion of the contract;
11) additional details related to the right of options are contained in the Essential provisions of the contract constituting Annex 4 to the SWZ.
4. As part of the subject of the contract, natural crushed aggregate with a fraction of 0-31.5 mm should be delivered, and the Ordering Party does not allow aggregate from the limestone group.
5. The supplied aggregate should have attestations, certificates and quality certificates required by law. It should be clean, without admixtures of undesirable materials (metal, plastic, wooden waste), clay, sand. Fine fractions must come exclusively from crushing the native material (fieldstone, granite).
6. The subject of the contract should comply with the PN-EN-13242 standard.
7. The Ordering Party reserves the right to control weighing of the delivered aggregate and control its quality. In the event of non-compliance of the declared scale with checkweighing or confirmation by laboratory testing of improper quality of the supplied aggregate, the Contractor shall bear the costs of such checks and tests. The contracting authority has the right to choose the laboratory in which the aggregate test will take place. For each course of aggregate supplied, the Contractor shall issue a delivery note specifying the quantity of aggregate. The document should be confirmed by an employee of the Contracting Authority or councillor, village head of a given village council and forwarded to the City and Commune Office.
8. The Contractor shall deliver the ordered aggregate successively, by self-unloading trucks (unloading at the back of the vehicle) to the place indicated by the Contracting Authority, in the City and Commune of Skępe.
9. The delivery must be made by 15.12.2023 for the basic order and for the order covered by the option, if the Ordering Party exercises the option right.
10. Delivery will take place on working days during working hours of the City and Commune Office in Skępe.
