The subject of the contract is the conclusion of a framework agreement for the supply of brand new suv cars in a police unmarked version, meeting the requirements set out in Annex 1 to the SWZ, which is the basic scope of the subject of the contract.

The subject of the contract is the conclusion of a framework agreement for the supply of brand new, year of production 2022, SUV passenger cars in a police unmarked version, meeting the requirements set out in Annex 1 to the SWZ, which is the basic scope of the subject of the contract. The estimated number of vehicles that the Ordering Party intends to buy is 118 units, however, the Ordering Party reserves that the number of vehicles being the subject of the contract may be increased or decreased depending on the prices offered resulting from the submitted offers, however, to the amount referred to in §3 section 1 of the draft framework agreement.

The Contracting Authority provides for the possibility of applying the right of option, consisting in increasing the scope of the basic subject of the contract by a maximum of 50 pieces of SUV passenger cars in an unmarked version. The Ordering Party guarantees that it will collect and pay for the basic scope of the subject of the contract, i.e. 118 cars.

Whenever, in these tender specifications and annexes, the subject of the contract is specified by indicating trademarks, patents or origin, the intention of the contracting authority was to represent the "type" of material or technology; in this case, the contracting authority shall allow the submission of equivalent tenders. In the case of describing the subject of the contract by means of standards, approvals, technical specifications and a reference system, it should be assumed that minimum requirements (not worse than) have been defined and at the same time the Contractor has been allowed to adopt solutions equivalent to those described. A contractor who refers to solutions equivalent to those described by the contracting authority is obliged to demonstrate that the deliveries offered by him meet the requirements specified by the Ordering Party.

List of subject documents, submitted together with the tender, confirming that the offered subject of the contract meets the specified requirements:

(a) a copy of the EC certificate of conformity of the base vehicle,

b) a statement that the offered vehicle meets the requirements of the Ordering Party described in Appendix No. 1 to the SWZ, i.e. the description of the subject of the contract, with the content specified in Appendix No. 1a to the SWZ,

c) The Contractor must confirm the fulfillment of all technical requirements for the base vehicle in the form of a detailed description of the subject of the contract and by marking individual data in the official catalogs (in Polish) of the manufacturer / importer of the vehicle, containing technical data and equipment of the base vehicle.

The Contractor together with the offer will present a proposal of at least 3 dark, subdued colors of varnishes (navy blue, brown, gray, black) from the official commercial offer of the manufacturer / importer of vehicles. The Ordering Party shall select the colours of varnishes from among those offered by the Contractor at the stage of signing the contract, indicating the number of vehicles in the selected colour. The Contractor shall mark the offered paint colours in the official catalogue (drawn up in Polish) of the vehicle manufacturer/importer.

All conditions for the execution of the contract have been specified in the SWZ and its annexes. The contracting authority will award a contract the subject of which is covered by a framework agreement, in accordance with Article 314(1)(1) of the PPL Act. The draft framework agreement specifies all the conditions for the performance of deliveries and the conditions for selecting contractors who will perform the contract.
