The subject of the order is the supply of electricity to GPZ Sklęczka field No. 46 section D and field No. 26 section B.
The term of the contract from 01.2020 to 31.12.2020.
Energy consumption is forecasted in the total amount of about 5,300 MWh during the contract period with the option of 10%, in the B 23 tariff group and the daily average price.
Assumed maximum power indicator: assumed hourly contractual power of 1 100 kW during the contract period.
The contracted capacity may be changed at the request of the Employer with one month's notice.
A detailed description of the subject of the contract in the ToR.
1) The supply of electricity will take place under the conditions set out in the provisions of the Act of 10.4.1997 - energy law and executive regulations.
2) Electricity should meet the technical parameters in accordance with the provisions of the Energy Law and executive regulations to this Act and Polish Standards. The Contractor undertakes to act as the entity responsible for commercial balancing for electricity sold under the concluded contract. The Contractor shall perform commercial balancing of energy purchased by the Employer on the basis of a standard consumption profile with the contracted capacity specified in the contract. Costs resulting from balancing should be included by the Contractor in the price of electricity given in the offer form.
3) The energy supplier is obliged to have a valid agreement with the DSO throughout the term of the contract enabling the sale of electricity to the Employer's facilities via the DSO distribution network appropriate for the Employer's facilities.
4) The estimated estimated amount of electricity (5,300 MWh) is for guidance only, is used to compare offers and does not constitute an obligation on the part of the Employer to purchase energy in the given amount. The Contractor shall not be entitled to any claim for charging the Purchaser with a different amount of energy than anticipated. Any change in the estimated consumption will not result in additional costs for the Ordering Party, except for the settlement of the amount of energy actually used at specific prices in the offer.
5) Contract duration: 12 months with three months' notice.
6) The contractor guarantees a fixed price during the term of the contract.
7) The Employer does not allow the Contractor to change the price of electricity during the term of the contract, except for the situation indicated in point 13.
8) The settlement for the electricity consumed will take place in accordance with the settlement period.
9) Monthly total electricity consumption around 500 MWh.
10) Annual overall electricity consumption around 5,300 MWh.
11) The net electricity prices offered must remain unchanged during the sale period and include costs related to commercial balancing and take into account the cost of fulfilling the obligations by the Contractor referred to in art. 9a paragraph 1 and 8 of the Energy Law (i.e. property law, green, yellow, red and purple).
12) The price must include the excise duty paid.
13) Amendments to the contract regarding price changes are allowed in the event of changes in legal provisions regarding:
a) VAT;
b) excise duty;
c) introducing or changing other fees;
d) taxes related to electricity;
e) changes in legal regulations resulting in an increase in costs affecting the cost of electricity.
In such cases, prices for electricity supplied under the contract are automatically adjusted by the value resulting from the above changes. The Contractor shall inform the Ordering Party in writing about the correction of the price of electricity supplied under the Contract, at the same time indicating changes in legal provisions constituting the basis for this correction.
14) New electricity prices will be binding for the Contractor and the Employer from the entry into force of the abovementioned legal provisions constituting the basis for their correction.
15) Electricity metering and accounting systems owned by the Employer are adapted to the technical requirements set out by PGE Dystrybucja SA Płock Branch.
16) The contract for the sale of electricity with the current seller will be terminated on December 31, 2019.
17) The Awarding Entity is not interested in hourly planning of energy consumption, however, it does not preclude the transfer of possessed information about planned repairs and technological breaks affecting the change of electricity consumption ...
