4. Where reference is made in the Specifications and Annexes to the specification to trade marks, patents or to the origin, source or specific process which characterises the products or services provided by a particular economic operator, such reference shall be accompanied by the words 'or equivalent' together with an indication of the criteria used to assess equivalence. The Contractor offering equivalent solutions is obliged to demonstrate at the stage of contract performance that the proposed solutions meet the requirements specified in the description of the subject of the Contract to an equivalent degree, subject to the provisions in point c) in Annex 2 to the Model Agreement (Annex 1 to the SWZ).
5. The Contractor shall be obliged to read and apply the recommendations resulting from the Code of Conduct for Suppliers of the Gas Transmission Operator GAZ-SYSTEM S.A. 6. The Contractor is obliged to read and apply the "Tenderer's (Contractor/Supplier's) Handbook", available on the Procurement Portal in the "Regulations and instructions" tab.
7. The Contracting Authority shall allow the possibility of a local inspection by the Contractors, at the latest 3 days before the deadline for submitting tenders. In such a situation, the Contractor is obliged, at least 2 days before the date of conducting the on-site inspection proposed by him, to apply using electronic means of communication within the meaning of the Act of 18 July 2002 on the provision of electronic services (i.e. Journal of Laws of 2020, item 344; hereinafter referred to as the "Act on the provision of electronic services") to the Ordering Party with a request to set the date (day and time) for the local inspection with a reservation, that the on-site inspection may take place from Monday to Friday, excluding public holidays, from 9:00 to 14:00.
8. All inquiries regarding the on-site inspection should be submitted via the Procurement Portal. The Contracting Authority allows the Contractor to obtain in this way all additional information that may be necessary for the preparation of the offer and the conclusion of the contract and performance of the Order. The on-site inspection is not a meeting of the Contractors referred to in Article 136 of the Act; therefore, during the on-site inspection, the Contracting Authority will not accept questions to clarify the content of the SWZ, nor will it answer the Contractors' questions. The costs of conducting a site inspection at the facility covered by the subject of the Order shall be borne by the Contractor.
9. The inspection will take place on the premises of the facility which is part of the critical infrastructure of the Contracting Entity, so each participant of the on-site inspection will be obliged to apply the safety rules in force at this facility.
10. The Contractor, via the Procurement Portal, indicates the name and surname of the person together with the ID card number and contact telephone number who will participate in the on-site inspection on his behalf. The contractor may delegate a maximum of 2 people to carry out the on-site inspection.
11. In order to enter the facility, each person is required to have appropriate personal protective equipment (including helmet, boots and protective clothing in non-flammable and antistatic versions). The inspection will take place on an active gas facility, therefore it may be necessary for the participants of the vision to stay in zone 2 of explosion hazard, therefore each participant will be familiarized with the hazards that may occur in the above-mentioned zone. You won't be able to take pictures during the vision.
